If you wish to place substances or mixtures on the market commercially or independently as part of a commercial enterprise to private end users that are labeled in accordance with the CLP Regulation (Regulation EC No. 1272/2008) with the hazard pictogram GHS06 (skull and crossbones) or the hazard pictogram GHS08 (health hazard) and the signal word Danger, and one of the hazard statements H340, H350, H350i, H360, H360F, H360D, H360FD, H360Fd, H370 or H372, you require a permit. This permit is issued to anyone who
- has proven their expertise in accordance with Section 11 (1) of the Chemicals Prohibition Ordinance (ChemVerbotsV),
- has the necessary reliability and
- is at least 18 years old.
Companies receive the permit for their facilities and operations if they have employees who meet the aforementioned requirements. The permit may be restricted to individual hazardous substances and preparations or to groups of hazardous substances and preparations. It may be granted subject to conditions. Conditions may also be imposed retrospectively.
No authorization is required for
- pharmacies or
- if they supply the substances concerned exclusively to resellers, professional users or public research, testing or teaching institutions.
Anyone who does not require a permit must notify the competent authority in writing of the first supply or provision of the substances or mixtures before commencing this activity. The notification must name at least one person who meets the requirements of Section 6 (2) ChemVerbotsV.
Documents proving that you meet the above requirements for the issue of a permit. A police clearance certificate is required as proof of reliability. Section 11 of the Chemicals Prohibition Ordinance (ChemVerbotsV) specifies how the required expertise is verified.

Sufficient expertise is a prerequisite for the permit. If the entrepreneur is not competent himself, he must employ persons in his company who are competent for the relevant activities. Qualified persons are druggists (under certain conditions), pharmacists, pharmacy engineers, pharmaceutical technical assistants, pharmacy assistants, certified pest controllers or persons who have completed vocational training as pest controllers. For these persons, the legislator assumes that they have acquired the expertise as part of their training. Other persons must take an additional examination of expertise in accordance with Section 11 (2) ChemVerbotsV with the competent authority or an institution recognized for this purpose by the competent authority.
