Feststellung einer Behinderung beantragen

Upon application, the State Office for Health and Social Affairs (LAGuS) determines the existence of a disability or severe disability, the degree of disability (GdB) and the existence of the requirements for the award of characteristics for claiming compensation for disadvantages.

People are severely disabled if they have a degree of disability of at least 50 and legally reside, habitually reside or work in Germany. Severely disabled people receive a severely disabled person's pass.

Determinations are not made if a determination of the existence of a disability and the degree of a reduction in earning capacity based on it has already been made in a pension decision or a corresponding administrative or court decision. This does not apply if an interest in another determination is substantiated or the determination of further health characteristics is requested.

If there are several impairments of participation in society, the degree of disability is determined according to the effects of the impairments as a whole, taking into account their interrelationships.

If you have medical documents relating to the health disorders listed in the application, please enclose these with the application. The originals will be returned to you immediately after evaluation. If you are able to enclose the complete medical findings for all the health disorders claimed, a faster decision on your application will be possible. The LAGuS will not reimburse any costs incurred for documents you have submitted yourself.

There are no costs or fees. However, you may incur costs for the medical certificates and attestations you submit.

In order to receive a decision, an application for the determination of a disability/severe disability must be submitted to the responsible department of the LAGuS/Social Welfare Office. Application forms are available at all LAGuS locations in person or by telephone, on the LAGuS website (can be filled out, printed and saved) or from the social welfare offices and associations for the disabled. An informal application can also be made. You will then be sent an application form. It is not possible to submit an application by e-mail.

If a person in gainful employment applies for a determination of their status as a severely disabled person, the deadlines specified in Section 14 (2) sentences 2 and 3 and Section 17 (1) sentence 1 and (2) sentence 1 SGB IX apply.

A determination is only to be made if there is a degree of disability of at least 20.
