The guardianship is generally to be carried out free of charge. If the guardianship is exceptionally carried out professionally (by a professional guardian), there is a right to remuneration. A guardian working on an honorary basis only receives remuneration in exceptional cases if the guardianship court approves such remuneration due to the scope and difficulty of the guardianship tasks in the case of wealthy guardians.
The remuneration of professional guardians is based on the provisions of the Guardianship and Caregiver Remuneration Act (VBVG) and therefore on the qualifications of the guardian.
A professional activity as a guardian is generally assumed if someone
- has more than ten guardianships or
- is expected to need at least 20 hours per week to fulfill their duties.
The family court is responsible for determining the requirements for professional status.
Note: No remuneration can be granted to the youth welfare office or an association (Section 1836 (3) BGB).
The invoice must first be submitted to the court. The court determines the amount of the remuneration claims.
Note: If the ward is destitute, the costs are borne by the state treasury.
The claim for compensation must be submitted to the family court no later than 15 months after it arises.
