If you are the owner or operator of public telecommunications networks and wish to lay or modify telecommunications lines in a public road, you can obtain consent for the shared use of traffic routes under certain conditions.

If you are the owner or operator of public telecommunications networks or telecommunications lines serving public purposes and wish to lay or modify telecommunications lines in public roads, you require the written or electronic consent of the carrier of the road construction obligation. You can submit an application in written or electronic form before the construction work is carried out.

The application must contain the following information

• the specific location of the pipe laying, in particular which road and road components are affected (stating the network node and kilometer)
• type of installation
• Laying depth

If you have submitted a complete application and the road construction authority approves the relocation or modification after examining the application documents, it will issue its approval by means of a notice. In the course of this, you are obliged to bear the administrative costs.

Under certain conditions, approval is deemed to have been granted after a period of 3 months following receipt of the complete application. In the case of only minor construction measures that are reported in full to the road construction authority, approval is deemed to have been granted if the road construction authority does not request that a corresponding application be submitted within 1 month.

• The application must contain information on the location of the relocation or modification of telecommunications lines, in particular which street and street components are affected, stating the network node and mileage.

• The application must contain information on the type and depth of installation.

• The application must be accompanied by a route plan, usually at a scale of 1:1000.
  

The applicant must be the owner or operator of a public telecommunications network or a telecommunications line serving public purposes. The structural implementation for the laying or modification of the telecommunications line takes place in a public road.

Administrative costs are incurred in accordance with the Thuringian Administrative Costs Act (ThürVwKostG) and the Thuringian Administrative Costs Regulations for the Ministry of Infrastructure and Agriculture (ThürVwKostOMIL).

• As the owner or operator of public telecommunications networks or telecommunications lines serving public purposes, you apply for approval to lay cables in the public road, submitting complete application documents.
• The public highway authority examines the application and, if necessary, grants approval subject to conditions and instructions by means of a decision in accordance with the Telecommunications Act (TKG).
• Under certain circumstances, an on-site meeting is required before the decision is issued.
• Under certain circumstances, a fictitious approval may also apply, i.e. approval is deemed to have been granted after a period of 3 months.
• The applicant is obliged to bear the administrative costs.

The application must be submitted in good time before the start of the construction project.
