If you want to run a prostitution business, then you must apply for permission to do so beforehand.
If you wish to operate a prostitution business, you must apply for a permit from the competent authority.
In order to receive the permit, you must fulfill certain minimum requirements, such as the submission of a permissible operating concept and proof of your reliability as an operator.
The permit can be limited in time. However, if you continue to meet the requirements, then you can apply for an extension.
Please note that according to § 1 of the "Thuringian Ordinance on the Prohibition of Prostitution", it is prohibited to engage in prostitution in municipalities with up to 30,000 inhabitants. Individual municipalities can be exempted from the ban in whole or in part by means of a legal ordinance. You can find out whether a corresponding exemption exists for a municipality with less than 30,000 inhabitants by contacting the responsible district office of the county.
You must include the following documents with the application:
a) Operating concept,
b) Building permit/use permit from the responsible building authority,
c) floor plan drawing,
d) lease agreement or proof of ownership,
e) certificate of good conduct ("certificate of good conduct for submission to an authority", document type O);
for legal entities, for the legal representative(s);
for persons designated to represent, manage or supervise the business,
a "certificate of good conduct for submission to an authority" must also be submitted.
f) extract from the commercial register (document type 9), in the case of legal entities for the legal entity and the legal representative(s),
g) certificate of the tax office in tax matters, in the case of legal entities for the legal entity and the legal representative(s),
h) in the case of legal entities, an extract from the Commercial Register; and
i) shareholders' agreement, if the business is organized in a form of private law company.
- The operator must have the required reliability.
- It must present a permissible and complete operating concept.
- Certain requirements regarding the organization and equipment of the commercial operation must be met. This applies, for example, to compliance with regulations for the protection of minors or victims of human trafficking, as well as health protection measures.
- An application must be submitted to the competent authority using the prescribed forms and enclosing the required documents.
- The submitted documents will be checked for completeness and conclusiveness.
- If necessary, additional documents will be requested.
- If necessary, a site visit will be arranged.
- A personal meeting is regularly arranged.
- If all requirements are met, the permit is issued. You will then receive a notice of approval. Otherwise, you will receive a rejection notice.
The obligation to obtain a permit under the Prostitution Protection Act does not replace the obligations to obtain a permit and to notify under other regulations (e.g. restaurant, trade, building or immission control law).
If you do not meet the legal requirements, you may be refused permission.
