If your vehicle deviates from the regulations of the StVZO or FZV and therefore cannot be registered, you can obtain an exemption under certain conditions.

Vehicles that do not comply with the construction and operating regulations of the Road Traffic Licensing Regulations (StVZO) require a special permit in accordance with Section 70 (1) StVZO in order to participate in public road traffic.
In principle, exemptions may only be approved if all reasonable possibilities for complying with the provisions of the StVZO and the Vehicle Registration Ordinance (FZV) have been fully exhausted.
They may only be approved to the extent that is absolutely necessary for the intended purpose (strict standard); no exemption may be granted for economic reasons alone.
The exemptions can generally be granted for a period of validity of up to 12 years; they can also be limited to three, six or nine years.
The exemption permits must be obtained by the vehicle owner, carried on the vehicle during journeys and handed over to the responsible persons for inspection on request.

For new applications, an expert opinion on obtaining an exemption permit in accordance with § 70 StVZO from an officially recognized expert for motor vehicle traffic or an authorized signatory of a technical service designated in accordance with § 30 of the EC Vehicle Approval Regulation (EG-FGV) for the inspection of complete vehicles of the respective vehicle class.

To extend an existing exemption permit: Copy of the old § 70 STVZO exemption permit. And either a confirmation report that the condition of the vehicle has not changed since the last inspection or a new report in accordance with § 70 StVZO.

To supplement or amend an existing exemption: Supplementary report (If towing vehicles or trailers other than those listed in the exemption permit, stating the vehicle identification number, are to be used in vehicle combinations such as trains or articulated vehicles, a supplement to the exemption permit is required).

To transfer an existing exemption permit: Existing exemption permit with the corresponding expert opinion and the registration certificates.

(If already available) Registration certificate or operating license of the vehicle combination.

(If available) Certificate from the manufacturer stating the reasons why he was unable to comply with the provisions of the StVZO.

Insurance certificate, if applicable (see Appendix 8).

Authorization if the application is made on behalf of a third party.

Voraussetzungen

As a general rule, exemptions may only be approved if all reasonable options for complying with the provisions of the StVZO and the FZV have been fully exhausted.

Kosten

Fees apply. Amount of costs (variable): from 10.20 to 511.00 euros. Legal basis: No. 255 Annex 1 to § 1 GebOSt. Note: The amount of the fees is based on the scale of fees for road traffic measures (GebOSt). There, a framework fee of €10.20 to €511.00 is set for each decision on an exemption from a provision of the StVZO per exemption and per vehicle/person; if there are several vehicles of the same design when the application is submitted, a reduced fee may be set. The exact amount of the fee depends on the processing effort, duration of validity and economic advantage for the applicant in each individual case; the determination is at the discretion of the authority.

Verfahrensablauf

You can apply for the exemption in writing or online. The application must be briefly justified.

Before you can apply for an exemption for a vehicle, you need an expert opinion from an officially recognized expert for motor vehicle traffic or an authorized signatory of a technical service designated in accordance with Section 30 of the EC Vehicle Approval Regulation (EG-FGV).

The report must state the necessary exemptions from the StVZO, the suitability of the vehicle or vehicle combination and the requirements and conditions deemed necessary in the interests of road safety. The proposals for exemptions must be described in concrete terms and their necessity must be justified. You can then apply for the exemption permit.

The competent authority will check your application, request additional documents if necessary and, if the check is positive, will issue you with the exemption permit and charge the fees.
