You may submit an application for early approval of a facility requiring a permit.

As part of an application for a permit under the Federal Immission Control Act (Bundesimmissionsschutzgesetz), you can submit an application for approval of an early start. In order to accelerate the planned project, the construction of the plant can also be permitted prior to the granting of the permit up to the testing of the operational capability in accordance with Section 8a (1) of the Federal Immission Control Act (BImSchG). This may involve the approval of individual erection steps or even the entire erection, whereby the approval of all erection measures is only permissible in exceptional cases.

The fees are based on No. 2.1.4 of the Thuringian Administrative Cost Regulations for the Business Division of the Ministry for the Environment, Energy and Nature Conservation (ThürVwKostOMUEN) of 14.10.2011.

• In a procedure for the granting of a permit, the licensing authority shall, upon application, provisionally permit construction, including the measures required for testing the operational reliability of the installation, to commence prior to the granting of the permit if
  • a decision in favor of the applicant can be expected,
  • there is a public interest or a justified interest of the applicant in the early start, and
  • the applicant undertakes to compensate for all damage caused by the construction of the facility up to the time of the decision and, if the project is not approved, to restore it to its previous condition.
