The following regulations apply to the protection of children and adolescents:

Alcoholic beverages:

  • 13 and under:

    • Dispensing (selling or serving) and consumption of alcoholic beverages are generally prohibited.

  • 14 and 15 years:

    Dispensing and consumption of beer, mixed beverages containing beer, sparkling wine, wine and mixed beverages containing wine are permitted if

  • a parent or guardian is present and allows it.

  • permits this.

  • 16 and 17 years of age:

    • Dispensing and consumption of beer, mixed beverages containing beer, sparkling wine, wine and mixed beverages containing wine are permitted even without supervision.

    • Dispensing and consumption of spirits and mixed drinks containing spirits remain prohibited.

  • 18 years and older:

    • Dispensing and consumption of spirits and mixed beverages containing spirits and all other beverages containing alcohol are permitted without restriction.

      Smoking:

  • under 18 years of age.

    • Children and adolescents are not allowed to smoke in public.

    • In addition, tobacco products (such as cigarettes, electronic cigarettes, electronic shishas, cigarillos, tobacco, snuff) may not be made available to them, i.e. sold.

    • Tobacco products and other products containing nicotine and their containers may not be offered to children and adolescents by mail order or given away by mail order.

    • The ban on distribution and consumption also applies to nicotine-free e-cigarettes and e-shishas.

Media

  • under 18 years of age

    • Children and adolescents may only watch films at public film events that have been released for their age.

      • "Released without age restriction"

Restaurants / dance venues, discotheques

  • Principle

    • How long children and adolescents are generally allowed to stay outside in the evening or whether they are allowed to stay overnight with friends is not regulated by law. This is decided by the parents.

    • Children and adolescents are generally not allowed to stay in night bars and gambling halls.

Restaurants

  • up to 15 years of age:

    • Children and adolescents under 16 years of age may only be allowed to stay in restaurants if they are accompanied by a person authorized by their guardian or legal guardian, or if they have a meal or a drink between 5 a.m. and 11 p.m.

  • 16 and 17 years of age:

    • Adolescents 16 years of age and older may not be permitted to be in eating establishments between midnight and 5 a.m. unless accompanied by a person authorized to have custody or a person responsible for their guardianship.

  • The above regulations do not apply if children or adolescents are attending an event organized by a recognized youth welfare organization or are traveling.

  • from the age of 18:

Staying in restaurants is allowed without restrictions.

Dance events, discotheques

  • up to 15 years:

    • Attendance at dance events and discotheques is only permitted in the company of a person authorized to have parental authority or a person responsible for the child's upbringing.

  • Deviating from this, children may be allowed to be present until 10 p.m. and young people under the age of 16 until midnight if the dance event is organized by a recognized youth welfare organization or serves the purpose of artistic activity or the preservation of customs.

  • 16 and 17 years:

    • Up to 24:00 hours, the stay at dance events and in discotheques is permitted without the accompaniment of a person authorized to have custody or a person responsible for the child's upbringing.

    • From 24:00 hours on, the stay is only permitted in the company of a person authorized to have custody or a person authorized to educate.

  • 18 years and older:

The stay at dance events and in discotheques is allowed without restrictions.

Adolescents under 16 years of age are generally only allowed to stay in restaurants, at dance events and in discotheques, if they are not accompanied by a person with custody (parent, guardian), if they are accompanied by a person over 18 years of age who has been entrusted by the parents to accompany and supervise them (person in charge of education).

This person can be, for example, an adult sibling or an adult friend.

In case of doubt, a corresponding assignment must be proven in writing. Parents usually give their children a note stating that they have been appointed. It should make clear that the assignment includes not only the accompaniment but also the supervision of the minor.

  • The two regulations mentioned above do not apply if children or young people are taking part in an event organized by a recognized youth welfare organization or are on a trip.

  • from the age of 18:

The stay in restaurants is permitted without restrictions.

  • up to the age of 15:

    • Attendance at dance events and discos is only permitted if accompanied by a person with parental authority or guardianship.

  • By way of derogation, children may be present until 10 p.m. and young people under the age of 16 until midnight if the dance event is organized by a recognized youth welfare organization or serves artistic activities or the cultivation of customs.

  • 16 and 17 years:

    • Until midnight, attendance at dance events and discotheques is permitted unaccompanied by a person with parental authority or guardianship.

    • After midnight, attendance is only permitted when accompanied by a parent or guardian.

  • from the age of 18:

Attendance at dance events and in discotheques is permitted without restrictions.
