If you as an organizer want to organize a fair, an exhibition, a wholesale market, a weekly market, a fair or a special market, you need the so-called determination of the competent authority. You must apply for this in writing.

In the context of the approval procedure, weekly, annual or special markets are considered to be events.

• A weekly market is a regularly recurring, time-limited event at which a large number of vendors offer, for example, food and raw natural products.
• A special market is one where specific goods are usually offered at regular intervals for a limited period of time.
• All kinds of goods are offered at fairs. In general, fairs are events that recur regularly at longer intervals and are limited in time.
• If you, as an organizer, want to offer a weekly, annual or special market, you must apply for a determination (permit) from the competent authority. The permit means that you as an organizer are exempt from some commercial obligations (for example, travel tissue map, compliance with store closing times).
• Organizers are natural persons and legal entities. Cities also often act as organizers, mainly in the case of weekly markets. If the market takes place in public space, a special use permit is required. In the application procedure, the competent authority checks the reliability of the applicant.
  

With the determination you as the organizer are allowed to hold the fair, exhibition or market, but at the same time you are also obliged to carry out the event. These types of events are exempt from the provisions of the Shop Opening Act and the Public Holiday Act.

• Completed application form or informal application with the following information:
  • Name of the organizer
  • date, time and place of the event
  • short description of the event
  • Information about the range of goods
• Certificate of good conduct of the organizer
• extract from the central business register
• expected list of participants
• occupancy plan of the intended rooms/areas
• Conditions of participation, if applicable
• if applicable, proof of public market advertisement (text and place of publication of the advertisement carried out prior to the application)
• Certificate in tax matters from the tax office of the place where you have lived or operated a business in the past 3 years
• Negative certificate of the insolvency court of the local courts in whose district you have had a residence or a commercial establishment in the past 3 years

If the event takes place in public space

In order for you to be approved for the event, you must

• Prove your personal reliability and the reliability of the persons entrusted with the management of the event. This is checked on the basis of excerpts from the Federal Central Register and the Central Trade Register.
• In addition, protection against danger to life and health must be ensured for the participants.
• The event must not pose a threat to public safety and order.
• The requirements of the trade regulations for the respective type of event must be fulfilled.
• A suitable venue must be available (for example, special markets may not be held in retail stores).

Fees are charged in accordance with the state's fee ordinance.

If you have submitted the application informally and all documents are complete, the competent body will check whether you meet all the requirements for granting the requested fixing of an event.

• Information that the informal application must contain:
  • Event date
  • Location
  • Opening hours
  • Event name, for example "Spring Market
  • Site plan with stands, bird's eye view of access roads
  • Preliminary list of participants with range of goods offered by participants
  • Blank contract concluded between organizer and traders

• If you meet all the requirements, approval will be granted.

As a rule, you will receive a decision within 3 months, as long as there are no regulations under state law.

An application deadline is not specified by law. However, a timely application (up to six weeks before the start of the event) is recommended.

In principle, anyone may participate in a trade fair, exhibition or market. As the organizer, however, you can restrict the event to certain groups of suppliers or visitors or exclude individual interested parties for objectively justified reasons. However, the selection among the applicants must be based on objective, verifiable selection criteria. These include criteria such as attractiveness, balance, versatility and novelty of the business operated by the applicant.

• Sales event fixing
• For the organization of a fair, market or exhibition, it is necessary to apply for the so-called fixing of the competent body.
• In the case of an approved market, at least 12 commercial participants (stands) are allowed.
• The fixing (approval) has the effect that the organizer is exempt from some commercial obligations (for example, travel tissue card, the observance of general store closing hours and Sunday and holiday rest according to the Working Hours Act, i.e. Sunday sales are possible).
