As an entrepreneur, you must immediately report accidents or operational malfunctions caused by activities involving hazardous substances to the responsible authority.

As an entrepreneur or tradesman, you are obliged to notify the competent authority without delay

• about every accident and every operational disturbance, which led to a serious health damage of the employees during activities with hazardous substances,
• about cases of illness and death in which there are concrete indications that they were caused by activities involving hazardous substances, with precise details of the activity and the risk assessment.

Notification of the authorities of any accident or breakdown must be made immediately, i.e. without culpable delay.

The accident report must not be confused with the accident report according to the law of the employers' liability insurance association ( § 193 SGB VII obligation to report an insured event). The two duties are independent of each other.

• Accidents or malfunctions caused by activities involving hazardous substances must be reported immediately.
• The accident report is independent of the accident report according to the law of the employers' liability insurance association. Both must take place.
