As the operator of facilities where animal experiments and similar activities are carried out, you must appoint one or more animal welfare officers and notify the competent authority of the appointment.
If you wish to carry out one of the activities listed below, you must appoint one or more animal welfare officers as the owner of the establishment or as the person responsible for the establishment and notify the competent authority of the appointment:
- You breed, keep or use vertebrates or cephalopods that are intended to be used in animal experiments;
- you breed, keep or use vertebrates or cephalopods whose organs or tissues are intended to be used for scientific purposes;
- they kill vertebrates in order to use their organs or tissues for scientific purposes;
- remove organs or tissues, in whole or in part, from living vertebrates for transplantation, culture or examination of isolated organs, tissues or cells for purposes other than scientific purposes.

- Documents proving that the appointed person fulfills the requirements (university degree, acquisition of relevant knowledge and skills in the field of laboratory animals)
- Information on the position (freedom from instructions) and powers of the animal welfare officer
- Application for exemption, if applicable
Note: A copy in the original language and a copy of a German translation are required for documents in a foreign language. Translations must be prepared by a publicly appointed or sworn interpreter or translator.
The animal welfare officer
- is not subject to instructions in the performance of their duties,
- has a degree in veterinary medicine (justified exceptions may be permitted in individual cases),
- must not also be the person responsible for breeding or keeping the animals (justified exceptions may be permitted in individual cases),
- may not at the same time be responsible for animal experiments that he/she carries out him/herself.
- has the specialist knowledge and skills required to carry out the tasks, which must be kept up to date with the latest scientific and technical developments through regular further training, and
- has the necessary reliability.
If several animal welfare officers are appointed, you must define their areas of responsibility.
Appointment:
Determine the persons to be appointed as animal welfare officers before starting the relevant activities.
- You must regulate the position and powers of the animal welfare officer by means of articles of association, internal instructions or in a similar form.
- If you appoint several animal welfare officers, you must define their areas of responsibility.
Notification:
As the person authorized to represent the facility, you must notify the TLV of the persons you have appointed as animal welfare officers.
- Submit the notification - together with an application for an exemption, if applicable - signed with the required documents by post or electronically to the competent authority.
The rest of the procedure is identical after submission online or by post:
- Once the notification has been received by the TLV, you will receive confirmation of receipt by email.
- The TLV will check the documents.
- If necessary, you will receive queries and the TLV will request any missing documents.
If all conditions are met, you or the notifying/applying institution will receive a confirmation of notification or a notification of approval of the exception.
You must make the notification before commencing the described activities of the facility.

- Appointment of animal welfare officer required if:
- vertebrates/vertebrate cephalopods are bred, kept or used that are intended for use in animal experiments;
- vertebrates/vertebrate cephalopods bred, kept or used whose organs/tissues are intended to be used for scientific purposes;
- vertebrates killed in order to use organs/tissues for scientific purposes;
- organs/tissues are removed in whole or in part from living vertebrates for the purpose of transplantation, culture or examination of isolated organs, tissues or cells other than for scientific purposes.
- Among other things, they advise on compliance with regulations, conditions and requirements in the interests of animal welfare
- Certain requirements must be met.
