Persons who engage in prostitution must register their activity with the competent authority.
The Prostitute Protection Act requires prior registration of the prostitution activity with the competent authority. The registration must be made in person.
Persons who wish to work as a prostitute must undergo a health consultation before registering for the first time. The competent authority will issue the person subject to registration with a registration certificate as proof of registration. This registration certificate can also be issued in anonymized form. The administrative services are subject to a fee.
Violations of the obligation to register can be punished by law.
A certificate confirming that you have regularly attended a mandatory health consultation is required for registration. In addition, an identity card/passport/passport replacement or ID replacement and, if applicable, proof of authorization for foreign persons not entitled to freedom of movement must be presented.
Both indoor prostitution and street prostitution are no longer considered immoral in Germany.
Prostitution is illegal, for example, if a corresponding ordinance (known as a restricted area ordinance) specifies certain places or times in which the practice of prostitution is prohibited.
Within these areas, for example, it may be prohibited to engage in prostitution on streets, paths, squares and bridges, in train stations and in all places that are public or can be viewed by the public in order to protect young people and public decency.
Violations of these regulations constitute administrative offenses that can be punished with a fine or, if repeated, as a criminal offense. In Rhineland-Palatinate, as in other federal states, corresponding restricted areas have been established in some cities.
