If you move into a new apartment, since the Federal Registration Act (BMG) came into force on November 1, 2015, you need a confirmation from your landlord/landlady that you have moved in. You must present this to the relevant registration authority each time you register.
The landlord/landlady is usually the owner of the apartment. However, it can also be the property management company appointed by the owner or, if you are living as a subtenant, the main tenant of the apartment.
The landlord's confirmation of residence must contain the following information:
- Name and address of the landlord/landlady
- Name and address of the owner (if he/she is not the landlord/landlady)
- Address of the apartment
- Names of all persons who move into the apartment and are therefore required to register
- Date of moving in, i.e. of the respective notifiable event
You can obtain the landlord's confirmation of residence from your landlord. The registration office responsible for you has a form for this purpose. The landlord's confirmation of residence must be signed by the landlord himself/herself.
The landlord/landlady is obliged to issue the confirmation no later than two weeks after moving in.
If the landlord/landlady refuses to issue the confirmation or if it is not possible for you to obtain the confirmation for other reasons, you must inform the competent registration authority immediately.
