If you want to use subsidized housing yourself, leave it empty for longer than three months or use it for purposes other than housing, you will need a permit. This is granted under certain conditions.

Erforderliche Unterlagen

  • identity card
  • Proof of income from all persons wishing to move into the apartment (e.g. proof of income to be completed by the employer, last income tax assessment/declaration and last tax-recognized profit or proof of tax assessment for tradespeople/self-employed persons).
  • Required proof will be requested by the responsible office.

Voraussetzungen

A permit for owner-occupation can be granted if the person entitled to dispose of the property himself fulfills the requirements for the granting of a certificate of eligibility. See also the description of "Issuing a residence entitlement certificate".

Permission to leave a property empty for longer than three months can be granted for two reasons. Firstly, if renovation or modernization is to be carried out and secondly, if letting is not possible and an exemption from occupancy and rent control would not lead to letting.

Permission to use the living space for purposes other than residential purposes can only be granted if there is an overriding public or private legitimate interest; the competent authority decides at its own discretion. It may demand appropriate monetary compensation or the granting of commitments with an overall equivalent value to other living space.

However, the granting of an exemption permit for use for purposes other than residential purposes can be made dependent on a monetary payment, among other things.

The application for permission for owner-occupation should be submitted before moving into a subsidized apartment.

The application for permission to leave the property empty should be submitted as soon as it is foreseeable that the subsidized rented accommodation will be empty for longer than three months.

The application for permission to use the property for purposes other than residential purposes should be submitted prior to the misappropriation of the living space.
