Are you an employer and certain protective measures of the Ordinance on Industrial Safety and Health can only be implemented at great expense and are not proportionate? Then you have the option of applying for an exemption.

The following serves to grant exceptions to the protective measures described in the Ordinance on Industrial Safety and Health

• for hazards due to energies,
• to further protective measures,
• the requirements for the maintenance and modification of work equipment,
• measures for special operating conditions,
• malfunctions and accidents,
• as well as the special regulations for elevator systems

Application with the following information

• reason for requesting the exemption, description of the disproportionate hardship
• Affected activities and procedures,
• number of employees likely to be affected,
• technical and organizational measures to be taken to ensure safety and avoid hazards,
• Expert opinion on the equivalence of the planned technical and organizational measures.

• Details of the employer / operator (applicant)
• Type of installation requiring monitoring

The prerequisite is that the application of these provisions would lead to disproportionate hardship for the employer in the individual case.

Fees and expenses are incurred.

1. Submission of the application and the expert opinion online
2. Follow-up action and review by the authority,
3. This is followed by the exemption decision or rejection of the application

After receiving an application, the competent authority decides whether the application of the prescribed measures would lead to disproportionate hardship, whether an exception is justifiable in terms of safety and whether it is compatible with the protection of employees and the protection of other persons.

The processing time is 4 weeks after receipt of the complete application documents.

No deadlines need to be observed.

The legal remedy will be communicated in the notification.
