If you carry out small-scale activities with asbestos-containing materials, a supplementary notification with the location and time of the work to be carried out is required in addition to the company-related notification.
Responsible: The health and safety authority responsible for the construction site
If you carry out small-scale activities with asbestos-containing materials, in addition to the company-related notification to the responsible occupational health and safety authority, a supplementary notification with the place and time of the work to be carried out is required and a copy of this must be sent to the accident insurance company. Only companies are obliged to notify the authorities.
The additional notification of place and time is required for the following reason:
The manufacture, use and processing of materials containing asbestos is generally prohibited for both companies and private individuals. Exceptions apply to demolition, renovation and maintenance work.
If this involves working with materials containing asbestos, you as the contractor must notify the relevant health and safety authority before starting the work. This notification can be company-specific or object-specific. A notification obligation only exists for companies.
Company-related notifications can be made for stationary (e.g. company site) or temporary (e.g. construction site) workplaces.
For temporary workplaces, a company-related notification is only possible in the following cases:
- Activities with low exposure (No. 2.8Technical Rules for Hazardous Substances - Asbestos, demolition, renovation or maintenance work (TRGS) 519)
- Low-emission work processes (No. 2.9 TRGS 519)
- Work on a small scale (No. 2.10 Para. 3 TRGS 519), i.e. asbestos cement panels in outdoor areas with less than 100 m2. (An additional notification of place and time must be submitted before work begins).
- Maintenance measures (No. 17 TRGS 519)
- Supplementary notification of place and time (Sample Annex 1.2 TRGS 519)
If necessary, submit to the authorities on request:
- Company-related notification
- Certificate of competence according to Annex 3 and 4 TRGS 519
- Risk assessment/work plan in accordance with Annex 1.4 of TRGS 519
- Operating instructions according to the model in Annex 1.6 and 1.7 TRGS 519
- Demolition, renovation and maintenance work on materials containing asbestos may only be carried out by specialist companies. At least one competent person authorized to issue instructions must be present on site during the work. Certificates of competence are valid for a period of 6 years. Further information on the specialist training courses can be found in Annexes 3 and 4 of TRGS 519.
- Demolition and renovation work on materials containing asbestos in weakly bound form may only be carried out by specialist companies that have an official license.
- Compulsory occupational health care in accordance with the Ordinance on Occupational Health Care must be carried out for all employees working with materials containing asbestos before work begins.
- You have submitted the company-related notification to the responsible occupational health and safety authority at least seven days before the start of the activity.
- In the case of small-scale work, a supplementary notification of place and time is required in addition to the company-related notification. This notification must be sent to the health and safety authority responsible for the location of the object (e.g. construction site) and a copy sent to the accident insurance company.
- You can start work immediately.
No processing time as only notification. In principle, there is no confirmation by the authority.
A copy of the notification must be sent to the responsible statutory accident insurance institution (e.g. BG BAU).
