If you would like to operate a car rental business, you will need a permit from the lower traffic authority responsible for you

You require a permit for the commercial transportation of passengers in rental cars. A corresponding application must be submitted to the lower transport authority responsible for you in the respective independent city or district.

- Formal application (surname, first name of the applicant; place of residence and business; for natural persons, date and place of birth; number, vehicle type, capacity of the vehicles to be used)

- Certificates of employment or examination certificates (for professional suitability) of the applicant or the person appointed to manage the business

- Equity certificate/additional certificate, not older than 3 months

- Clearance certificate from the tax office, the municipality, the social security institutions and the employers' liability insurance association, not older than 3 months (from the entrepreneur, the legal representative and the person appointed to manage the business/transport manager)

- Certificate of good conduct for submission to the authorities

- Extract from the central trade register n (for companies)

- Extract from the driving aptitude register (FAER)

General documents:

- Vehicle list, if applicable rental vehicles with rental contract or leasing list

- Proof of liability insurance for rental cars incl. risk identification number (WKZ)

- Business registration

Note: The competent authority may request further documents.

If the applicant fulfills the approval requirements in accordance with § 13 paragraph 1 of the Passenger Transport Act (PBefG), a rental car permit can be issued in accordance with. § 49 PBefG can be issued.

The permit may only be issued if the licensing requirements are met, i.e.

• the safety and efficiency of the operation is guaranteed
• there is no evidence that the applicant as the operator or the person appointed to manage the business is unreliable
• the applicant as entrepreneur or the person appointed to manage the business is professionally qualified
• the applicant and the contractors commissioned by the applicant to provide transport services have their registered office or place of business within the meaning of commercial law in Germany.

In the case of legal entities under public law, the approval requirements pursuant to Section 13 (1) shall be deemed to have been met.

Framework fee for the permit: 50.00 euros to 500.00 euros

For regular cases it is

• 60€ for the first vehicle
• 30 for each additional vehicle.

These amounts are not binding for the licensing authority.

In the event of excessive administrative costs, the licensing authority may deviate from this up to the maximum amount of the framework fee.

Issuing or re-issuing a rental car permit

The processing time may vary between the responsible lower traffic authorities.

The processing time may depend, among other things, on whether all documents relevant to the decision have been submitted or subsequent requests for documents become necessary.

Deadlines do not begin to run until a decision-ready application has been submitted. If the application is complete, a decision on the application must be made within 3 months. The deadline can be extended by three months if necessary.
