A person who wants to care for one or more children outside the household of the legal guardian during part of the day and more than 15 hours a week for a fee for more than three months requires permission in accordance with the legal basis in the Eighth Book of the Social Code (SGB VIII). This is granted by the local youth welfare office, located in the districts or independent cities. The permit is limited to five years. It may be provided with ancillary provisions. The permit authorizes the care of up to five foreign children present at the same time.

Permission must be granted if the person is suitable for child day care. This is to be assumed if she is characterized by her personality, expertise and willingness to cooperate with legal guardians and other child day care workers and has child-friendly premises.
It also requires good knowledge of the requirements in child day care, which it has acquired in qualified courses.
After submission of the documents of the completed qualification as a child day care person, police certificate of good conduct, medical certificate and joint inspection of child day care person and the local youth welfare office for the purpose of checking the spatial suitability, the care permit will be issued. The care of children can only take place after permission has been granted.

The granting or refusal of a permit for child day care constitutes an administrative act. Information on the right of appeal must therefore be included.
