Vorübergehende Rechtsdienstleistungen: Registrierung

In principle, anyone wishing to provide out-of-court legal services in the following areas must register with the competent authority:

• debt collection services,
• Pension advice in the field of
  • statutory pension and accident insurance,
  • social compensation law,
  • other social security and severely disabled law relating to a statutory pension as well as occupational and occupational pensions,
• legal services in a foreign law; if the foreign law is the law of a member state of the European Union or another state party to the Agreement on the European Economic Area, advice may also be given in the field of European Union law and the law of the European Economic Area

According to § 15 of the Legal Services Act (RDG), anyone who is legally established in the territory of the European Union (EU) or the European Economic Area (EEA) for the exercise of a profession comparable to one of the legal services subject to registration may also provide this service occasionally and temporarily in Germany.

• certificate that the person or company is legally established in a Member State of the European Union or in another State party to the Agreement on the European Economic Area for the exercise of one of the professions referred to in § 10 para. 1 of the Legal Services Act (RDG) or a comparable profession and that he or she is not entitled to pursue this activity at the time of submission of the certificate, not even temporarily, is prohibited
• Proof that the person or company has lawfully pursued the profession in the State of establishment for at least two years during the previous ten years, if the profession is not regulated there
• Information on the existence or non-existence and extent of professional indemnity insurance or other individual or collective protection in relation to professional indemnity

There are no fees.

There are no deadlines to be observed.

Anyone wishing to provide out-of-court legal services in the following areas must in principle register.

The jurisdiction lies with the regional court and the larger district court (so-called Präsidialamtsgericht).
