Under certain conditions, the State Office for Environmental and Occupational Safety and Health can grant a permit for the storage of pyrotechnic articles upon application.
According to § 17 of the Explosives Act,
1. the construction and operation of warehouses in which hazardous substances are to be stored for commercial purposes within the framework of an economic enterprise or an agricultural or forestry enterprise or when employing workers,
2. a substantial change in the nature or operation of such warehouses
a permit. The storage of pyrotechnic articles (fireworks) is possible up to the free quantities specified in Annexes 6 and 7 of the 2nd Explosives Ordinance without a storage permit. If you want to store pyrotechnics beyond this quantity, you need a storage permit.
The State Office for Environmental and Occupational Safety can issue a permit for the storage of pyrotechnic articles if the legal requirements are met and you submit an informal application.
This application shall contain at least:
- Name and address of the applicant, copy of the permit according to § 7 SprengG for handling explosive substances
- Information on the type and quantity of explosive substances (BAM group, storage group, compatibility group)
- Field map with marked deposit
- Floor plan of the deposit.
The State Office for Environmental and Occupational Safety checks the documents received and usually drives on site to inspect the premises and to view surrounding buildings and roads.
Depending on the storage group and quantity, protective distances to neighbouring buildings and traffic routes must be observed. Depending on the storage group, these are calculated using a formula according to Annex 1 of the 2nd Explosives Ordinance.
If all conditions are met, a storage permit is issued. Depending on the effort, a storage permit can be expected after about 3-4 weeks.

On application, a permit for the storage of pyrotechnic articles may be granted. The prerequisite for this is a permit according to § 7 SprengG for handling explosive substances as well as a safe storage location that meets the requirements of the 2nd Explosives Ordinance.

- In order to obtain a storage permit, you must submit an informal application to the Land Office for Environmental and Occupational Safety and attach all the documents required for a decision on your application. This must also include a detailed description of the project and the location.
- The documents submitted by you will be checked for completeness and conclusiveness and, if necessary, additional documents will be requested. After complete receipt of all required documents, the responsible clerk will inspect the storage location on site. For this purpose, he/she will usually make an appointment with you, in which you will again have the opportunity to explain the project.
- The clerk checks the structural requirements and the distances to neighbouring buildings and traffic routes on site.
- If necessary, the clerk can then request further documents (e.g. an expert's opinion) in order to be able to issue a storage permit if all conditions are met.
- If all conditions are met, the permit can be granted. If the conditions are not met, a negative decision will be issued.
In order to simplify communication and speed up the procedure, you should name a contact person in your company and provide their contact details when submitting the application.
