The responsibility for hazards from explosive ordnance during construction work lies with the property owners or persons commissioning the construction. Even in cases of suspicion, measures must be initiated, such as a preliminary investigation of explosive ordnance (evaluation of war aerial photographs).

During the war years and to this day, explosive ordnance from both world wars has been searched for in Lower Saxony. But even at the present time, it must be assumed that large quantities of unrecognized explosive ordnance are still present in the ground. Even after decades of storage of these war remnants in the ground, the danger posed by these various explosive ordnance has not diminished.

The Lower Saxony Explosive Ordnance Disposal Service is able to carry out evaluations of aerial war photographs for you in advance of construction work, which provide information on the extent to which war effects have been caused by air raids.

• Completed written application in accordance with the form provided,
• Map material (property map 1:500 – 1:2,000 preferred) with clear marking of the area to be evaluated (maps not larger than DIN A3),
• optional: Digital geodata (Esri Shapefile (ETRS89, EPSG 25832), kml/ kmz, ...) which contain only the requested evaluation area as a polygon.

There are no prerequisites.

Remark:

The evaluation of aerial photographs is subject to a fee in accordance with § 6 NUIG in conjunction with § 2 para. 3 NVerwKostG. If the applicant acts as a contractor for third parties, a power of attorney is required for the recognition of the obligation to pay costs.     

The costs depend on the size and complexity of the application area and amount to between €69 and €500 plus VAT per application. Cancellation free of charge is only possible if it is made in writing and the evaluation of the war aerial photographs has not yet begun.

Due to the persistently high number of applications, there may be longer processing times. Current times can be found on kbd.niedersachsen.de

If a valid evaluation is already available for the requested area, you will receive the result immediately. Otherwise, the area must be evaluated. The processing time is influenced by several factors, e.g. the number of applications still to be processed, the sizes of the requested areas, the respective number of war effects to be recorded and the number of images already available. Since the duration cannot be specified exactly due to these factors, only an expected processing time is mentioned in the confirmation of receipt.

Notice of assessment of costs:

An action against the assessment of costs may be lodged with the Court within one month of notification.

In the case of a request for administrative costs, the suspensive effect of an appeal does not apply in accordance with Section 80 (2) sentence 1 no. 1 of the Code of Administrative Court Procedure. The payment obligation therefore continues in principle.
