In special cases, highly qualified foreign nationals can obtain a settlement permit without prior residence periods in Germany. In particular, the following are considered highly qualified in this sense:

• Scientists with special specialist knowledge or
• teachers in a prominent function, or
• scientific staff in a prominent function.

• Proof of compliance with passport and visa requirements
• Proof of secure livelihood
• Proof of professional or scientific qualification
• Employment contract
• Proof that there are no grounds for expulsion against you
• Proof that you do not endanger or impair the interests of the Federal Republic of Germany
• Proof that your integration into the living conditions of the Federal Republic of Germany is secured.

Depending on the other requirements you need to meet, the competent authority may require additional documentation. Please inquire at the responsible foreign representation or the immigration authority which documents are required.

The prerequisites for the settlement permit are:

• They meet the passport and visa requirements.
• Your livelihood is secured without using public funds.
• There is no ground for expulsion against you.
• Your stay does not endanger or impair the interests of the Federal Republic of Germany.
• They are highly qualified in the sense mentioned above.
• Their integration into the living conditions of the Federal Republic of Germany is ensured.

Note: Highly qualified persons are not entitled to participate in an integration course

• Appeal against the decision of the immigration authority within one month of notification.
• Legal action before the court named in the objection notice if the objection is not upheld.

• Settlement permit issued for particularly highly qualified specialists
• The settlement permit is an independent right of residence, independent of the original purpose of residence, which entitles the holder to pursue gainful employment without restriction.
• Eligible group of persons (examples, list not exhaustive):
  • Scientists or academics with special expertise,
  • teaching staff in a prominent position or
  • academic staff in a prominent position.
• Issuance in special individual cases
• No prior minimum stay in Germany required.
• Prerequisites:
  • At least two years of professional experience,
  • Integration into the living conditions of the Federal Republic of Germany expected,
  • Independent means of subsistence.
• Federal states may stipulate that the granting of a settlement permit requires the approval of the highest state authority or a body designated by it.
• Responsible: the foreigners authority responsible for the applicant's place of residence
