If you want to operate an assessment centre for fitness to drive, you need recognition by the competent authority under state law. The prerequisites are that the financial and organisational capacity of the institution is guaranteed, that the staff is staffed with a sufficient number of doctors and psychologists, that an officially recognised expert or examiner for motor vehicle traffic is available for cases of need, that the necessary premises and equipment are available, that the body is provided by the Federal Highway Research Institute with regard to the fulfilment of the conditions applicable to it. professional requirements have been positively assessed and the person authorised to represent the body responsible for assessment centres for fitness to drive are reliable.
Recognition may be accompanied by ancillary provisions, in particular conditions.
All documents that provide information about the existence of the above-mentioned conditions are required.
In the case of an application, signed by a person entitled to represent the institution, the following documents shall be attached:
1. proof of the legal form of the institution, name of the legal person,
2. information on the organisation and management of the institution, its activities and its relations with a parent organisation;
3. addresses of all assessment bodies in the area of responsibility of the respective recognition authority,
4. for each assessment body in the area of responsibility of the respective certification authority, a certificate from the competent authority attesting compliance with the Ordinance on Workplaces,
5. where other recognition has already been granted, a list of existing recognition notices, stating the recognition authority, file number and date of recognition; Copies of the notices shall be submitted on request.
6. Proof of professional indemnity insurance
7. Proof of the total turnover of the last three completed financial years or, in the case of first issue, other proof of the financial capacity and economic independence of the experts from the appraisal result
8. Proof of qualification of the doctors and psychologists employed in the assessment centre
9. Proof of the availability of an officially recognised motor vehicle traffic expert or inspector per assessment centre
10. Proof of the suitability of the psychological test procedures and equipment used by an appropriate independent body
11. Expert opinion of the Bundesanstalt für Straßenwesen pursuant to Paragraph 72(1)(1) of the FeV
12. proof of a certificate of good conduct by the applicant; in the case of legal persons, for those persons who are authorised to represent them by law or by their articles of association
Recognition shall be granted if:
1. the financial and organisational capacity of the institution is ensured,
2. the staffing of a sufficient number of medical and psychological experts is ensured,
(a) Requirements for the medical expert:
aa) a doctor with at least two years' clinical experience or specialist (in particular internal medicine, psychiatry, neurology);
bb) in addition, at least one year's experience in assessing the suitability of drivers in an assessment centre for fitness to drive,
b) Requirements for the psychological assessor:
aa) diploma or equivalent master's degree in psychology and at least two years of practical professional activity (usually in clinical psychology, industrial psychology),
bb) in addition, at least one year's experience in assessing the suitability of drivers in an assessment centre for fitness to drive,
cc) Hospitation at a complete course for the restoration of fitness to drive (§ 70) in case of lack of knowledge and experience in the implementation of these courses,
3. the sponsor proves for all experts that the requirements for annual continuing training in accordance with the directive pursuant to § 72 (2) no. 1 have been met,
4. an officially recognised expert or inspector is available for motor vehicle traffic,
5. the material equipment with the necessary premises and equipment is ensured,
6. the body responsible for assessment centres for fitness to drive is not at the same time responsible for driver training measures or courses to restore fitness to drive, and does not carry out measures to change behaviour and attitude in preparation for an assessment of fitness to drive,
7. the suitability of the psychological test procedures and equipment used has been confirmed by an appropriate independent body,
8. the body responsible for assessment centres for fitness to drive proves compliance with the requirements by means of an expert opinion of the Federal Institute (in the context of the initial assessment, this proof is limited to the fulfilment of the requirements with regard to the documentation of quality management and the spatial, material and personnel equipment)
9. the participation of the institution in a regular and nationwide exchange of experience under the direction of the Federal Institute is ensured,
10. the economic independence of the experts from the result of the appraisals is guaranteed, and
11. the applicant, in the case of legal persons, the persons authorised to represent them by law or by their articles of association and having the requisite good repute required for the activity;
As a result of the opposition procedure, which has largely been abolished in Lower Saxony, bringing an action before the Administrative Court would be the first instance remedy. For local jurisdiction, reference is made to § 52 No. 3 VwGO.
