The notification of the placing on the market / trade / sale of plant protection products can be made in Lower Saxony to the Chamber of Agriculture of Lower Saxony.

If your place of business or the place where you operate is located in another federal state, you must also notify the authorities there.
Offering and supplying plant protection products commercially also includes online and mail order sales.
The obligation to notify also applies to the import of plant protection products from abroad or the transportation of plant protection products within Europe, in each case for commercial purposes.
You must state your name and address or the name and address of your company. If several competent persons in your company place plant protection products on the market, you must state the names and addresses of all these persons. In addition, you must enclose proof of expertise in the supply of plant protection products for all the competent persons named in the notification.
You must notify the competent authority immediately of any changes to the group of persons and any changes that affect the details of the business as well as the cessation of the business.
Plant protection products are intended to protect plant products and plants, in particular crops (such as arable farming, viticulture or fruit growing) against harmful organisms and other adverse effects. Plant protection products may only be used if their use is unlikely to adversely affect human and/or animal health or groundwater. Other significant harmful effects, especially on the ecosystem, must also be excluded. Plant protection products may only be used on outdoor land if they are used for agricultural, forestry or horticultural purposes. However, they shall not be used in or directly on surface and coastal waters.
Before commencing any commercial activity involving plant protection products, this must be notified to the authority responsible for the place of business and the place of activity. The obligation to notify exists before the start of the activity if plant protection products are to be placed on the market or imported for commercial purposes or in the context of other economic undertakings.
According to the Plant Protection Act (PflSchG), the use of plant protection products is only permitted to persons who have the necessary technical knowledge and skills and can guarantee that no avoidable harmful effects on nature, humans and animals occur as a result of the handling of plant protection products. Plant protection expertise must therefore be proven by persons who
- use plant protection products on an agricultural holding (including horticulture or forestry) or for the protection of stocks,
- carries out a notifiable activity (e.g. supplying plant protection products in the retail trade or providing commercial advice on the use of plant protection products) or
Instruct or supervise persons who use plant protection products in the context of an apprenticeship.

To ensure that you comply with your notification obligation under the Plant Protection Act in good time, you must
- complete the relevant application form and send it to the competent authority before commencing your activities and
- attach to the application form proof of the required plant protection expertise in accordance with the Plant Protection Act of the persons in the company who place plant protection products on the market. Since 26.11.2015, only the new certificate of competence in check card format has been valid as a certificate of competence.

Once you have submitted the application and all documents are complete, the competent authority will check whether all requirements for notification in accordance with the Plant Protection Act have been met.
If all documents are complete, you have fulfilled your obligation to notify in accordance with the Plant Protection Act.
You may only commence your activities once you have fulfilled the obligation to notify in accordance with the Plant Protection Act.

- Fill in the form on the computer, sign and attach a copy of the certificate of competence (both sides).
- Submit the documents to the plant protection office of the LWK Niedersachsen.
- The contact details can be found on the first page of the form.
- You will receive a registration number and a fee notice by post.

You may only commence your activity once you have fulfilled the obligation to notify in accordance with the Plant Protection Act.
If you do not comply with your obligation to notify or do not do so in good time, you are acting in breach of the regulations.
The notification of trade in plant protection products must be made before the start of activity.
- If you do not comply with your obligation to notify or do not do so in good time, you are acting in violation of the regulations.
- The notification in accordance with the Plant Protection Act does not replace the trading permit for toxic substances in accordance with the Chemicals Prohibition Ordinance.
- According to the Plant Protection Act, persons who carry out an activity requiring expert knowledge in plant protection and have a certificate of competence in plant protection are obliged to take part in a recognized advanced training course at least once within a three-year period.
- Persons who, for commercial purposes or in the context of other economic activities, arrange the placing on the market, intra-Community movement or import of plant protection products in or into Germany or offer auxiliary services for the import or intra-Community movement of plant protection products must notify the Federal Office of Consumer Protection and Food Safety before commencing their activities in accordance with the Plant Protection Act.
