In accordance with No. 3.2 TRGS 519, demolition, remediation and maintenance work must be submitted informally to the responsible regional inspection of the TLV at least 7 days before the start of the planned asbestos activities. A distinction must be made between the company-related notification for activities with asbestos-containing materials (Appendix 1.1), the supplementary notification of place and time (Appendix 1.2) and the object-related notification for activities with asbestos-containing materials (Appendix 1.3). Failure to report is an administrative offence.
Note: According to Annex I No. 2.4.2 of the Hazardous Substances Ordinance, demolition and remediation work on or in existing facilities, buildings or vehicles containing weakly bound asbestos products may only be carried out by companies that have been approved by the competent authority to carry out this work and have the necessary personnel and safety equipment suitable for the work.
The advertisement must contain at least information about:
- name, address and telephone number of the executing company,
- Address of the construction site (location of the workplace),
- type of product (asbestos products and quantities),
- the nature of the activity (activities to be carried out and procedures used);
- start or duration of activities with asbestos,
- Number of employees handling hazardous substances containing asbestos,
- Name of the competent supervisor (TRGS 519),
- Approval of asbestos (GefStoffV Annex I No. 2.4.2 para. 4, only for weakly bound asbestos products) and
- Operating instructions (§14 GefStoffV).
Any company that submits a company-related notification for asbestos demolition and remediation work and is suitable in terms of personnel and safety may carry out the asbestos activities after notification has been made to the competent authority. For work on weakly bound asbestos, official approval is required in addition to the corresponding expertise.
Corresponding personnel and safety requirements are specified in TRGS 519 "Asbestos, demolition, remediation or maintenance work" (as of January 2014).
Each company must have at least two qualified persons permanently employed by the company. According to this, at least one competent person and his representative must be appointed for the personnel of the company and, in the case of extensive work, an equipment expert (assumption of functions by the responsible person or his representative is possible). The number of additional restructuring specialists must be specified.
The written notification must be submitted by a person authorised to represent the company authorised to carry out this work.
The competent authority must be notified at least 7 days before the start of the activities with asbestos-containing materials. If the seven-day deadline cannot be met for urgent work, the competent labour inspectorate may agree to a reduction in the deadline.
If you commission subcontractors at ASI, you are also responsible for ensuring that only approved specialist companies that have the personnel and safety equipment are used for the activities. Subcontractors (including sole proprietors without employees) are fully subject to the requirements of TRGS 519.
A copy of the company-related notification must be carried at the place of work.
