If your permit for the commercial exhibition of persons is at risk of expiring because the business has not been started within one year of the permit being issued or has not been operated for a period of one year, you can apply for an extension of the deadline for the expiry of the permit.
The decision to extend the deadline is at the discretion of the authority. An extension can only be granted if there is good cause. Good cause can be assumed if circumstances beyond your control and outside your area of responsibility make it impossible for you as the permit holder to meet the deadline. The authority will also take into account whether the public interest is opposed to an extension of the deadline and whether a new permit procedure appears necessary. An extension may therefore be considered in the event of illness, destruction of the facility or business premises through no fault of your own, but not in the event of temporary insolvency or a temporary ban on trading.

Fees are charged in accordance with No. 40.1.8 of Annex 1 to Section 1 (1) of the General Fee Regulations of the State of Lower Saxony (AllGO).
The extension of the deadline must be applied for before the deadline for the expiry of the permit expires.
The one-year period begins when the permit is issued, i.e. from the date on which the permit is received by the authorized addressee.
If the addressee (usually the applicant) has legal doubts or concerns about the decision, these can be reviewed by the competent administrative court, depending on their legal nature, by way of an action to enforce or challenge the decision.
In Lower Saxony, Section 80 of the Lower Saxony Judiciary Act does not provide for preliminary proceedings. Therefore, no objection is admissible; instead, an administrative court action must be brought directly.
