If you, as a property owner, find explosive ordnance on your property, you must report this immediately, otherwise you will be liable to prosecution and expose yourself and other people to high danger.

Ordnance includes all ammunition intended for warfare, in particular bombs, mines, grenades, explosives and detonators.

Often, explosive ordnance is not recognizable as such. Many are rusted beyond recognition or resemble commercial utensils in appearance.

The obligation to report also applies to walkers who find ammunition.

In principle, § 7 of the Lower Saxony Police and Regulatory Authorities Act (NPOG) results in the responsibility of the property owner.

Therefore, the costs of explosive ordnance disposal on properties owned by the federal government are also borne by the federal government itself.

In the case of explosive ordnance disposal on non-federally owned properties, the Land shall bear the costs of defusing, salvageing, transporting and destroying Allied ammunition for reasons of equity. The expenses for formerly Reich-owned found ammunition are generally reimbursed by the federal government within the framework of so-called state practice.

Means of warfare are

• all munitions used in warfare
• especially bombs, mines, grenades, explosives and detonators
• are usually unrecognizable, rusty or resemble commercially available articles of daily use

Explosive ordnance found must be reported immediately:

• by property owners who find explosive ordnance on their property
• walkers who find munitions are also obliged to report them
• Failure to comply with the immediate reporting obligation is a criminal offense, as other people are exposed to a high level of danger

Fees:

Costs of explosive ordnance disposal:

• are the responsibility of the property owner
• on properties owned by the federal government, the costs of explosive ordnance disposal are borne by the federal government itself
• on non-federally owned properties, the costs of explosive ordnance disposal are borne by the state for reasons of equity (defusing, salvaging, transportation and destruction of allied munitions)
• Expenses for munitions formerly owned by the Reich are reimbursed by the federal government in accordance with the so-called state practice

The responsibility lies with the municipality, the joint municipality and the city as well as the nearest police station.
