Vocational training in Germany takes place predominantly in the dual system. This term means training in a business enterprise, in administration or in practices of a liberal profession on the one hand and in the vocational school on the other, i.e. at two places of learning.

In the case of school-based vocational training (full-time school), both practical and theoretical training takes place at the vocational school.

The basis for in-company training in the dual system is the Vocational Training Act (BBiG) and for training in a skilled trades the Act on the Organization of Handicrafts (HwO). Both laws regulate, among other things, the rights and obligations of training companies and trainees, the vocational training contract, which must in any case be the individual legal basis of a training relationship, the system of recognised training occupations and the tasks of the competent authorities, i.e. usually the chambers of industry and commerce, chambers of crafts, etc.

The legal basis of the second place of learning, the vocational school, is the Lower Saxony School Act (NSchulG). The most important provision here is compulsory vocational schooling: trainees must attend vocational school, regardless of whether they have already completed the general 12-year compulsory schooling or not.

This obligation is based on the fact that the in-company training content and the vocational school curricula are coordinated, so that the abandonment of vocational school attendance would make the overall training incomplete. In addition, the Vocational Training Act stipulates that the vocational school curriculum must also be the subject of the final examination. The vocational school thus has its firm place in the dual system of vocational education and training.
