As a company, do you want to transport waste across national borders? Then the provisions of the EC Regulation on shipments of waste apply to you.
All waste for disposal and recovery that is to be shipped across national borders must generally be notified. The only exception is waste for recovery that is listed in Annexes III, IIIA and IIIB as well as V Part 1 List B of the WSR and is to be shipped within the EU. This exception also applies to the import and, in some cases, the export of waste from or to EFTA states (Iceland, Switzerland, Norway and Liechtenstein), to states that have ratified the Basel Convention and to most states that are party to OECD Council Decision C(2001)107. Only the so-called "general information requirements" apply to this waste.
For the types of waste listed below, the notification procedure does not have to be carried out for certain shipments; instead, the "general information requirements" pursuant to Article 18 of the WSR apply. The completed form in accordance with Annex VII of the WSR must accompany the waste shipment. Furthermore, a contract must be concluded between the person arranging the shipment and the consignee, which must be effective at the start of the shipment and which must meet the requirements of Article 18(2) of the WSR in terms of content. If the shipment fails or is illegal, the initiator of the shipment must take back the waste at his own expense or otherwise recover it. He undertakes to do this in the contract. He also agrees to temporarily store the waste if necessary (see also Article 18 Paragraph 2 of the WSR). It is recommended that the contract also be carried along during transportation.

The waste is listed in Annex III of EU Regulation 1013/2006,
- the waste is recycled,
- there is no prohibition according to? Chapter 6 of EU Regulation 1013/2006,
- Properly executed form and contract in accordance with Article 18 of EU Regulation 1013/2006 (see Annex VII of EU Regulation 1013/2006)
- Contract on the recovery of the waste between you as the initiator of the shipment and the consignee in accordance with Article 18 of EU Regulation 1013/2006
If necessary, according to expenditure (especially in the case of retrievals) in accordance with the fee schedule of the Ministry of the Environment, Health and Consumer Protection (GebOMUGV), subheadings 3.23.1 - 3.23.4
As an exporter, you must conclude a disposal contract with the recipient of the waste for the take-back of the waste, if retrieval is necessary. You must submit the contract to the control authorities and the waste authority responsible under state law upon request.
In addition, the person arranging the shipment must complete the "Transit Information" form before each waste shipment (Annex VII of Regulation (EC) 1013/2006). This must be carried by the transporter when transporting the waste.
When the waste is taken over, the recipient or the operator of the disposal facility signs the form and keeps it. The person who initiates the shipment will receive a copy of it.
The forms and copies thereof must be kept by all parties involved for three years and must be presented at any time upon request.
Note: In the context of inspections and/or monitoring, various authorities, such as the competent waste law authority or the police, may require the documents to be submitted.
