Drones are unmanned aerial vehicles which, together with the remote control, form what is known as an "Unmanned Aircraft System" (UAS). They can be used in a variety of ways. The following activities are possible with the help of drones, for example:
- Photographing or filming subjects
- Rescue fawns
- Surveying areas
If you use a drone, you may also want to fly over geographical areas for which you need permission. A geographical (UAS) area is a part of the airspace defined in accordance with air traffic regulations that permits, restricts or excludes UAS operation. This is intended to avoid risks to the following areas
- public safety
- the protection of privacy and personal data
- protection from noise pollution
- the environment
The following are examples of nationally applicable geographical (UAS) areas:
- Federal highways
- Federal waterways,
- Nearby airfields and airports
- nature conservation areas
- Residential properties
Permission is required in the following cases, for example:
- You want to fly over a geographical (UAS) area but are unable to obtain permission from the operator or the responsible authority
- You want to operate your aircraft near airports or over residential properties without consent and at an altitude of less than 100 meters
If you have a legitimate interest in doing so, you can obtain a permit to fly in geographical (UAS) areas from the relevant state aviation authority.

- A1/A3 certificate of competence or A2 remote pilot certificate
- Self-declaration of practical skills
- detailed maps or aerial photographs, such as Google Maps, in which the planned flight sector and take-off or landing sites are marked
- written consent from the owner of the land
- Order from affected authorities, agencies or operators
- Approval from German air traffic control
- Expert opinion on the suitability of the site and the airspace concerned
- Further assessments and expert opinions, for example in the area of noise and nature conservation
State of Brandenburg:
The application for an individual permit consists of the following documents:
- - detailed maps or aerial photographs in which the planned flight sector and the take-off or landing sites are marked,
- - proof of sufficient liability insurance for personal injury and property damage in accordance with §§ 37 (1) (a), 43 of the German Air Traffic Act (LuftVG) in conjunction with § 101 ff of the German Air Traffic Licensing Regulations (LuftVZO),
- - the proof of competence of the remote pilot required under EU law
- - Transit permit from the Federal Supervisory Authority for Air Traffic Control (for flight operations in restricted flight areas) and
- - Operating permit if the operation takes place in the "special" operating category
The Berlin-Brandenburg Aviation Authority also has the right to request the following evidence and information, among others
- - written consent of the respective landowner or the person authorized to use the land in the event of take-off and/or landing on a property
- - Special use permit from the responsible district office for take-off or landing on public land in Berlin
- - in Brandenburg, written consent from the responsible regulatory authority
- - for natural persons: Copy of identity card or registration certificate, business registration; proof of freelance activity, if applicable,
- - for legal entities and companies under commercial law: an excerpt from the register of associations, commercial register or register of cooperatives as proof of legal power of representation,
- - Proof of successful participation of the pilot in a briefing/training course on the operating system by the manufacturer, alternatively self-declaration regarding experience in handling model airplanes/model helicopters,
- - Technical details/evidence of the unmanned aircraft and
- Proof of safety measures to maintain distances from uninvolved persons.

- Geographical individual permit:
- private: 65.00 €
- commercial: 80.00 €
- additional costs: discretionary
- additional geo-zone + 20.00 € (in Berlin)
- Operating permit: depending on the amount of work involved, from EUR 200.00
State of Brandenburg:
- Geographical general permit: 2-3 weeks
- Geographical individual authorization: 2-6 weeks (depending on the individual case)
- Operating permit: 2-6 weeks (depending on the individual case) (task of LBA)
Which state aviation authority is responsible for authorizing drones to fly into geographical areas depends on the location of the drone and not on your company or place of residence.
