Änderung einer genehmigungsbedürftigen Anlage nach BImSchG Genehmigung im Rahmen von Repowering einer Anlage zur Erzeugung von Strom aus erneuerbaren Energien

The modification permit is granted if:

it is ensured that the obligations arising from the requirements of the Federal Immission Control Act and the Federal Immission Control Ordinance are fulfilled and

other public law regulations and occupational health and safety concerns do not conflict with the construction and operation of the system.

A permit for wind turbines in the context of repowering may also not be refused if, after modernization, not all immission guide values of the technical instructions for protection against noise are complied with, but

the immission contribution of the wind turbine after modernization is lower than the immission contribution of the wind turbines it replaces and

the wind turbine corresponds to the state of the art.

A fee is charged for the decision on a permit application in accordance with tariff item 2.1.1 of Annex 2 of the Fee Schedule (GebOMUGV).

A decision on the application for approval must be made within three months (up to 19 wind turbines) or within six months (over 19 wind turbines) of receipt of the application and the complete documentation to be submitted.

Notification is only required if the change may have an impact on the protected goods listed in Section 1 of the Federal Immission Control Act.

In some federal states, the ELiA application is available free of charge for submitting applications
