Anyone offering food or drinks commercially on an event-related basis must notify the competent authority at least two weeks in advance.

A temporary catering business is operated by anyone who, on a commercial basis, for consumption on the spot

• serves drinks or
• serves prepared food,

if the restaurant is open to the public or certain groups of people and is only operated temporarily for a specific occasion such as a party, anniversary or other event.

Anyone wishing to operate a restaurant business temporarily for a specific occasion must notify the competent authority for the location in question in writing using the form in accordance with Section 2 (2) BbgGastG (notification of a temporary restaurant business - Gagev) two weeks before the start of the business.

This notification must also state

• what type of establishment it is and
• whether it is intended to offer alcoholic beverages.

The following types of establishment may be considered

• Snack bar
• public house
• Restaurant
• Pub and restaurant
• Open-air bar area (beer garden)
• café
• bar
• with music performance
• with dancing
• Wine tavern

• The notification is made on the "Gagev" form
• Identity card or passport for identification purposes
• Foreigners who are not citizens of an EU member state or an EEA member state require a residence permit from the responsible immigration authority, according to which they are permitted to exercise the trade under immigration law

The notification must be made for the serving of alcoholic and/or non-alcoholic beverages as well as for the serving of food at temporary activities, such as club parties.

The notification must be submitted to the competent authority two weeks before the start of operations.

The following authorities are involved by the trade authority:

• Food monitoring authority
• Lower building supervisory authority
• Environmental department of the independent towns, municipalities and offices
• tax office

A temporary catering business exists if drinks or prepared food are offered commercially and consumed on site for a special occasion (e.g. party, anniversary). The notification must be submitted in writing to the competent authority at least two weeks in advance and must include details of the type of establishment and the serving of alcoholic beverages.

Local regulatory authorities according to § 1 BbgGastGZV.

The duties of the local regulatory authorities are carried out by the local authorities, the independent municipalities, the association municipalities, the co-administrating municipalities, the co-administered municipalities and the independent cities (§ 3 of the Regulatory Authorities Act - OBG)

This procedure can also be handled by a "single point of contact". The "Single Point of Contact" is a special service offered by the municipalities and the state for service providers.
