Parties and voter groups that are not represented in the Bavarian State Parliament or the German Bundestag must first notify the state electoral officer of their participation in the state or district election. The state electoral committee must determine their right to participate.
Political parties and other organized groups of voters who have not been continuously represented in the Bavarian state parliament or the German Bundestag since the last election on the basis of their own nominations may only submit a nomination as such if they have notified the state election officer in writing of their participation in the election and the state election committee has established their right to nominate candidates.
Parties/voters' groups that are not represented in the state parliament or Bundestag but are represented in the respective district assembly are exempt from the notification of participation for the district election.
The notification must include the name of the party or group of voters, if a short name is used, this must also be included. The name and abbreviation of an electoral group are determined by the body appointed to represent it in accordance with the constitution; they must be clearly distinguishable from the name of an existing political party or other organized electoral group.
- Political party: written statutes, written programme and proof that the executive committee has been appointed in accordance with the statutes.
- Other organised electoral group: written statutes, written proof of establishment and proof that the executive committee has been appointed in accordance with democratic principles.
The notification of political parties must be signed by at least three members of the executive committee of the state association, including the chairman or his deputy, or, if there is no state or district association, by the next lower regional or district association; the notification of other organized voter groups must be signed personally by the executive committee of the voter group.
The Land returning officer examines the notification of participation immediately upon receipt. If he finds any deficiencies, he shall immediately notify the party or group of voters and request them to rectify any deficiencies in good time.
The Land electoral committee shall make a binding determination for all electoral bodies no later than the 79th day before the election day - in the case of an election following the dissolution or dismissal of the Land parliament no later than the 27th day before the election day,
- which political parties or other organized groups of voters have been continuously represented in the Bavarian State Parliament or the German Bundestag since their last election on the basis of their own nominations,
- which associations that have notified their participation in accordance with Art. 24 are otherwise entitled to submit nominations; the rejection of the right to submit nominations requires a majority of two thirds of the votes cast.
The Land returning officer shall invite the associations that have notified their participation in the election to the meeting at which a decision is made on their recognition as a political party or other organized group of voters for the election. He presents the notifications of participation to the state electoral committee and reports on the result of the preliminary examination. Before the resolution is passed, the parties present are given the opportunity to make a statement. Following the determination, the Land returning officer announces the decision of the Land electoral committee.
Participation in the election must be notified in writing to the Land returning officer by 6 p.m. on the 90th day before election day at the latest - in the case of an election following the dissolution or dismissal of the Landtag by 6 p.m. on the 31st day before election day at the latest.
