The governments accept applications for the dedication, reclassification and withdrawal of federal and state roads as well as for changes to the list of federal, state and district roads.
The dedication, reclassification and confiscation of federal highways and state roads is carried out by the supreme road construction authority, the Bavarian State Ministry of Housing, Building and Transport. State Ministry for Housing, Construction and Transport. In the case of federal highways, the Federal Highway Authority is responsible, unless dedication, reclassification and confiscation are carried out as part of a plan approval. The governments are responsible for examining and forwarding applications from state building authorities for the dedication, reclassification and confiscation of federal and state roads to the Supreme Road Construction Authority.
Dedication and reclassification of district roads is the responsibility of the administrative districts/municipalities. Reclassification outside the road class of federal and state roads is carried out either by a consensual reclassification agreement between the road authorities involved or by supervisory reclassification. The mutually agreed reclassification agreement must be notified to the road supervisory authority responsible for the future road class, i.e. the government in the case of district roads. The road supervisory authority can object to the mutually agreed reclassification within 2 months (so-called reminder).
If the road authorities involved do not agree on the traffic significance of a road, the responsible road supervisory authority, i.e. the government, decides if the highest road authority involved is a district administrative authority.
For federal roads, state roads and district roads, the supreme road construction authority keeps so-called road directories. All roads are included in the road directories according to their road class. The governments are responsible for examining and forwarding applications from districts and independent municipalities for changes to the road register for district roads to the Supreme Road Construction Authority.
Changes to the road lists for federal, state and district roads must be applied for via the government at the State Ministry for Housing, Construction and Transport.
For a supervisory reclassification, the responsible road construction authority should submit a written application to the government.
The reclassification by mutual agreement must be submitted by the road construction authority to the responsible road supervisory authority in good time before the intended reclassification date.
Regulatory reclassifications should generally take place at the end of the financial year and must therefore be applied for in good time. They should be announced to the road authorities involved 3 months in advance.
The objection to a consensual reclassification (reminder) and the supervisory reclassification/rejection of the supervisory reclassification can be contested by the road authorities involved.
