Non-profit and commercial collections of recyclable waste from private households must be notified to the district administrative authority before they are planned.
The district administrative authority (district office or district-free city) may impose conditions and requirements or limit the collection period.
Commercial collection must be prohibited if:
- there are concerns about the reliability of the notifier or the person responsible for the collection, or
- the collection conflicts with overriding public interests,
i.e. it prevents the public waste management authority from fulfilling its disposal obligations under economically balanced conditions or significantly impairs its planning security and organizational responsibility. The latter is to be assumed if- waste is collected for which the public waste management authority carries out household or other high-quality separate collection and recycling of the waste,
- the stability of fees is jeopardized or
- the non-discriminatory and transparent awarding of waste disposal services in competition is made considerably more difficult or undermined.
Waste electrical and electronic equipment from private households may only be collected or taken back by public waste management authorities, distributors, manufacturers or their representatives, or by operators of primary treatment facilities certified in accordance with Section 21 of the Electrical and Electronic Equipment Act.
- Specifications:
- the size and organization of the company (company name, address, telephone number, name of the managing director, non-profit status yes/no; legal form, number of employees, activities in other federal states)
- the type, extent, duration and location of the collection (details of the start date, type (e.g. home collection, container collection), frequency, collection area, planned duration)
- the type, quantity and destination of the waste to be recycled (designation of the waste fractions, expected collection quantities, destination (e.g. sorting plant, export, direct sale))
- on the proper and safe recovery of the waste and the recovery routes (description of the recovery routes including the securing of recovery capacities, names of the recovery companies, information on the capacities of the disposal facilities)
- The collection must not conflict with any overriding public interests.
- The waste must be recycled properly and without causing damage.
- There are no known facts that give rise to concerns about the reliability of the collector.
Non-profit and commercial collections of recyclable waste from households must be notified to the competent district administrative authority at least three months before the start of the collection.
