If you want to install a garden irrigation fountain in the garden of your private home, you must inform the responsible authority.

If you want to access groundwater using a well and use it to irrigate your private garden, you must notify the responsible authority.

• It is a private garden that belongs to your own home.
• The property on which the garden irrigation fountain is to be located is outside a water protection area. In Hamburg, water protection areas are located in
  • Baursberg,
  • Billstedter,
  • Curslack/Altengamme,
  • Eidelstedt/Stellingen Langenhorn/Glashütte
  • Süderelbmarsch/Harburg Mountains
• The garden irrigation fountain is used exclusively for watering your garden and not for commercial purposes.

• You submit the report online.
• The system will immediately inform you if there is anything preventing the construction of your garden irrigation well.
• At a later date, you will usually also receive a confirmation email from the responsible office with further instructions.

In certain circumstances, a notification is not sufficient. You must apply for a permit instead. This is the case if

• the well is to be located in an allotment garden or a plot of land that is only used seasonally.
• the fountain is located in the garden of an apartment building
• the property is not only used for private purposes.
• the well is located in a water protection area.

According to the Explosive Ordnance Ordinance of January 1, 2006 (Section 5), the property owner is obliged to carry out a survey when intervening in the building site. Therefore, you are responsible for clarifying the suspicion of explosive ordnance before construction begins, at your own expense.

In addition, you or the company commissioned to drill the well must report the drilling via the online portal “Norddeutsche Bohranzeige”. According to the Geology Data Act, this must be done at least two weeks before work begins.
