Section 27 (1) of the Housing Allowance Act (WoGG) Change in housing allowance - increase
https://www.gesetze-im-internet.de/wogg/__27.html
https://www.gesetze-im-internet.de/wogg/__27.html
If you are already receiving housing benefit, you can, in certain cases, apply for an increase in housing benefit.
If you already receive housing benefit, you can apply for a higher housing benefit if:
- Your total income has decreased,
- more people live in your household, or
- Your rent or home ownership costs have increased.
- Evidence of changes in rent or encumbrance
- Proof of changed income
- Evidence of changes in the household members to be taken into account
- Your total income has decreased by more than 10 percent compared to your previous application.
- There are more people living in your household who are taken into account.
- Your rental costs or the costs of your home ownership (excluding heating costs) have increased by more than 10 percent.
If your income decreases because fewer people live in your household, this can also be a reason for an increase in housing benefit.
- You apply for the housing benefit increase with all necessary documents to the responsible authority.
- The responsible authority will review your application and documents. If necessary, they will request additional documents or information from you.
- The responsible authority will decide on your application.
- You will receive a notification.
- You receive housing benefit.
The responsible office will process your application as quickly as possible. How long it takes depends on how complete your information is and whether all the necessary documentation is available. Even if processing takes longer, you will not be disadvantaged. Your housing benefit entitlement will be reviewed from the day you submit your application. You will not lose any housing benefit if you are entitled to it.
- If it is determined that you are entitled to more housing benefit, the higher housing benefit will normally be paid from the first of the month in which your application is received by the housing benefit office.
- The housing benefit increase takes effect from the day you submit your application. As a rule, housing benefit cannot be increased retroactively.
To ensure that housing benefit is paid out legally, the housing benefit authority may regularly check the members of your household through a so-called data comparison.
- Application for an increase in housing benefit is possible at:
- already approved housing benefit notice
- decreased total income
- increased number of household members
- increased rent or burden on home ownership
- Changes can, but do not necessarily, lead to more housing benefit
- Increase applies from the date of application
- Subsequent increase in housing benefit is generally not possible
