If you have extensive professional experience in a non-regulated profession (e.g., in skilled trades, commerce, industry, or IT), you can obtain a residence permit to pursue employment. You have extensive professional experience if you have gained at least two years of professional experience at the level of the desired occupation in Germany within the last five years.

To obtain a residence permit, you do not need to have your qualifications acquired abroad recognized in Germany. However, you must have one of the following qualifications:

  • a foreign professional qualification which is officially recognised by the country in which it was acquired and which required a period of training of at least two years to obtain,
  • a foreign university degree that is officially recognized by the country in which it was obtained, or
  • a professional qualification obtained abroad through training awarded by a German Chamber of Commerce Abroad.

The Central Office for Foreign Education, for example, will check in advance whether these requirements are met and will issue you with a certificate.

The work must be qualified. Your employer must pay you a salary of at least 45 percent of the annual contribution assessment ceiling for general pension insurance. An exception to this requirement applies if the employer is bound by a collective bargaining agreement and employs you under the applicable collective bargaining conditions.

Before issuing a residence permit, the Federal Employment Agency must approve your employment. The residence permit is issued for a limited period of time. Its validity depends on your employment contract or the duration of the approval by the Federal Employment Agency.

Erforderliche Unterlagen

  • Valid passport
  • Proof of at least two years of professional experience within the last five years
  • Proof of foreign qualification (for example, with a certificate evaluation or digital information on professional qualifications from the Central Office for Foreign Education)
  • If available: further evidence of your knowledge (e.g. certificates)
  • "Declaration of Employment Relationship" form completed and signed by the employer
  • Current biometric photo in digital form (can be taken on site)
  • Proof of your health insurance
  • rental agreement
  • If applicable: current visa (if required for your entry) or current residence permit or other certificate of your right of residence (e.g. residence permit, toleration)

Voraussetzungen

  • You have a recognized and valid passport or passport substitute and - if required for entry - an appropriate visa.
  • There is no interest in deporting you.
  • Your stay does not endanger or impair the interests of the Federal Republic of Germany.
  • You have worked in the relevant field for at least 2 years within the last 5 years.
  • You have completed a foreign vocational or higher education qualification.
  • You have an employment contract or a binding job offer for a non-regulated activity.
  • Your salary will reach at least 45% of the pension insurance contribution assessment ceiling.
  • You can secure your livelihood and health insurance coverage independently without relying on public benefits.
  • The Federal Employment Agency has approved your employment (approval is usually obtained automatically by the responsible agency after you submit your application).

Verfahrensablauf

  • You use the online service to apply for a residence permit and upload the required documents.
  • The responsible office will then send you an appointment for an interview.
  • Please bring all required documents, preferably in their original form, with you to the appointment.
  • The responsible authority will check your identity and documents.
  • The competent authority shall involve other authorities where necessary.
  • If your application is approved, your fingerprints, signature and a biometric photo will be taken to produce the electronic residence permit (eAT).
  • The responsible authority commissions an external body, the Federal Printing Office, to produce your eAT.
  • As soon as the eAT is ready, you will receive a notification and can pick it up in person from the responsible office. The responsible office will give you an appointment for this.
  • If the application is rejected, you will receive a rejection notice with the reasons for the rejection.

Bearbeitungsdauer

Processing will begin immediately at the appointment if all documents are complete. The Federal Employment Agency's involvement takes up to two weeks. The delivery time for the electronic residence permit from the Federal Printing Office is then typically two to four weeks.

Frist

You should apply for a residence permit at least eight weeks before your valid visa or residence permit expires.

The residence permit is issued for a limited period of time. Its validity depends on the duration of your employment contract and the approval of the Federal Employment Agency.

Hinweise

If you want to work in an IT profession, you do not need to submit proof of a foreign qualification
Under certain circumstances, the responsible authority may require you to attend an integration course. This will then be noted on your residence permit.
