If you want to use a public green space or recreational facility in a particular way, you need permission.

Public green spaces and recreational areas (e.g. parks) are intended to serve the health and recreation of citizens. They are intended for public use. This means that these areas are accessible to everyone and can be used by the general public without the need for special permits or restrictions.

If you use public green spaces and recreational areas beyond common use, for example for

• the holding of an event
• the operation of a commercial leisure facility
• setting up beehives
• offering goods and services

This constitutes special use. You must apply for permission in advance.

• Informal application for a special use permit
• Documents setting out the type and extent of the special use (for example, a sketch with details of the dimensions)

• Their special use must not violate nature conservation or landscape protection regulations.
• Your special use must protect the interests of citizens seeking recreation and must not significantly restrict or inconvenience them. Neighbors must also not be unreasonably disturbed by your special use.
• Their special use must not cause disproportionate damage to the green area.

There is a fee for issuing the permit. Fees may also be charged for using the area. The amount of the fees depends on the type, extent and location of the special use.

• You submit an application and submit the necessary documents.
• Your application will be reviewed and, if necessary, missing documents or information will be requested from you.
• You will receive a notice of approval or a notice of rejection.
• You will receive a fee notice.
• You pay the fees

The processing time depends on the type and scope of your application, as well as the quality of the documents submitted.

Even if all the actual and legal requirements are met, you are not entitled to be granted a special use permit. The responsible authority decides on your application at its own discretion.

The responsible authority will grant you the special use permit for as short a period as possible in order to minimize damage to the green space and recreational area. The responsible authority can require you to pay for the repair of damage caused by your special use. The responsible authority can also require you to make an advance payment or deposit a sum of money as security.

The permit is granted to you subject to revocation. This means that the permit granted can be withdrawn. The permit is subject to conditions that you must comply with.

A special use permit is only granted to you for part of a green area in order not to unreasonably exclude other people seeking recreation from using the area.

Depending on the project, you may need additional permits or authorizations in addition to the special use permit. You are responsible for ensuring that you have these.
