If you manage a guardianship professionally, you can demand remuneration for it. For guardianships managed on a voluntary basis, this is only possible under certain conditions.

The fee is 23 euros per hour. If the guardian has special knowledge that can be used to manage the guardianship, the hourly rate increases

• to 29.50 euros if his knowledge has been acquired through a completed apprenticeship or comparable completed training;
• to 39 euros if his knowledge has been acquired through completed training at a university or through comparable completed training.
• Any sales tax incurred on the remuneration will be reimbursed additionally.

If the particular difficulty of the guardianship matters justifies this in exceptional circumstances, the family court may grant a higher hourly rate than the stipulated rate. This does not apply if the ward is destitute.

In the case of professionally managed guardianships, remuneration can be claimed in accordance with the Guardians and Caregivers Remuneration Act.

In the case of voluntary guardianships, a flat-rate expense allowance or reimbursement of expenses required to manage the guardianship may be required.

• Apply for compensation for the guardianship you are carrying out at the responsible family court.
• Please attach the required documents.
• If necessary, explain why a higher remuneration is justified in this case.
• The family court will examine your application.
• It requests documents if necessary.
• You will receive approval for your compensation.
• Your remuneration will be paid to you.

Processing is usually done promptly.

The claim to payment of the flat-rate expense allowance (for voluntary guardians) expires if it is not asserted within 6 months after the end of the year in which the claim arose.

The claim to remuneration (for the professional guardian) expires if it is not asserted in court within 15 months of its creation.

Complaint

Guardianship is generally free of charge and voluntary

• no entitlement to remuneration, but reimbursement of expenses
• In exceptional cases, the Family Court may grant reasonable compensation: in difficult cases and if the ward is wealthy.
• Professional guardianship with remuneration according to the Guardians and Caregivers Remuneration Act.
• if the guardian has more than ten guardianships or
• at least 20 hours per week are required for the leadership
• If ward is destitute, compensation and advance or reimbursement of expenses from the state treasury

• Remuneration is 23 euros per hour.
• If special knowledge is available:
  • 29.50 euros for completed apprenticeship or comparable completed training
  • 39 euros for completed training at a university or comparable completed training
• VAT will be reimbursed additionally
• Exceptionally higher hourly rate if special difficulty of guardianship and ward not destitute
