If you are summoned to an appointment at the family court and are unable to attend you can cancel the appointment by telephone.

Please note that a medical certificate is required if you are ordered to appear in person. Otherwise you will be fined.

You can inform the family court by telephone if you are unable to attend an appointment.

  If personal appearance is ordered: presentation of a medical certificate.
  Mandatory content: The certificate must contain the diagnosis and the medical statement of the inability to negotiate.

You are unable to attend the appointment.

The following information is required:

• business number
• Which appointment is to be canceled
• Your surname, your first name

You can also provide the following information:

• Your telephone number
• Times when you can be reached by telephone
• Suggestions for suitable alternative appointments
• Your (family/legal) relationship to the person concerned

Cancellation by telephone.

A fine may be imposed on you if you fail to appear without an excuse.

The absence must be excused in good time so that the appointment can be canceled and the parties involved notified.

Medical certificates must be submitted immediately.

To avoid a fine, a later submission is sufficient if the late submission was not your fault (Section 381 (1) sentence 2 ZPO).

The submission of evidence (certificate or similar) is not subject to any formal requirements (copies are sufficient).
