As an employer, you can, under certain conditions, apply for working hours for employees in your company that deviate from working time regulations.
As an employer, you can, under certain conditions, apply for a permit for longer daily working hours for employees in your company.
The permit is provided by law for:
- continuous shift operations
- Construction and assembly sites
- Seasonal and campaign operations
The application must be submitted to the locally competent authority for occupational health and safety.
- For all farms:
- Information on the activity
- Number of workers for whom authorisation is to be granted
- Contact person in the company with contact details
- Risk assessment (especially with regard to psychological stress caused by longer working hours)
- Opinion of the company doctor
- Opinion of the staff delegation (if any)
- Additionally for continuous shift operations:
- Duty schedules/shift schedules that prove that the extension of working hours results in additional free shifts.
- Schedules for day and night shifts, from which in particular the break possibilities can be seen.
- Additionally at construction and assembly sites:
- Information on the nature and severity of the work
- Organisation of working time
- Distance between place of work and place of residence
- Duration of rest period at the place of residence
- In addition, for seasonal and campaign operations:
- Information about season or campaign
- Organisation of working time
- Period during which working hours are reduced.
You can request an extension of your employees' daily working hours under the following conditions:
- For continuous shift operation when additional free shifts are achieved. Additional free shifts exist if the extension of working hours means that more free consecutive days are available for the employees concerned than before.
- For construction and assembly sites, particularly relevant if the place of work is far away from the workers' place of residence and the employees are guaranteed a correspondingly longer rest period at the place of residence for the extended working time on the construction or assembly site.
- For your seasonal or campaign operation, if there is an extraordinary workload for the specific season that cannot be compensated by other organizational measures.
- The granting of the permit or the rejection of your application is subject to a fee. The fees are country-specific and are calculated according to administrative costs or depend on the number of employees to be deployed.
You can apply in writing for permission for deviations from shift work. To do this, the following steps must be performed:
- You submit an informal application.
- They send it to the competent local authority, including the necessary documents.
- If the required documents or information for processing are incomplete, you will be contacted by Processing.
- The locally competent authority for occupational safety and health examines the application.
- After completion of the official examination, you will receive a notification of approval or a rejection notice.
- The competent local authority will send you the notification by e-mail or by post.
The decision of the competent occupational safety and health authority is made at its due discretion.
In the context of this decision, a balance is struck between the interests of protecting the safety and health of workers and the operational interests of the employer.
