The provider of a facility in which children or adolescents are cared for or accommodated for the whole day or part of the day requires permission to operate this facility.
A permit is not required for the operation of
- a youth leisure facility, a youth education facility, a youth hostel or a school hostel,
- a school hostel which is subject to state school supervision,
- a facility that performs tasks for children or youths outside the scope of youth welfare if it is subject to corresponding statutory supervision or serves to accommodate children or youths within the scope of the hotel and catering industry.

Using the application form, the provider must
- Application for operating permit according to § 45 SGB VIII (original)
and enclose the annexes indicated on the form.
The granting of an operating licence requires that the provider ensures the well-being of the children and young people and their care through
- structural,
- personnel
- minimum standards in terms of construction, staffing and pedagogy.
- Contact the State Youth Welfare Office (Landesjugendamt) to find out whether the intended offer is the operation of a facility requiring a permit.
- If this is the case, you must submit an application for an operating licence, enclosing other necessary documents. In particular, the concept of the facility must be submitted with the application.
- The State Youth Welfare Office examines the submitted documents and advises you on the further requirements.
- It always conducts a local inspection before opening a new facility, with the participation of the provider, the responsible youth welfare office, other responsible specialised offices and the central assiciation organisation. The results of the inspection are summarised in an inspection report and sent to the parties involved.
- If the prerequisites for operating a facility are met, it receives the corresponding notice of approval from the State Youth Welfare Office (Landesjugendamt).
- If certain prerequisites are missing, a notice may be provided with ancillary provisions or the application for an operating permit may be rejected.
Operating a facility requiring a permit without an operating licence is an administrative offence. It can be punished with a fine of up to EUR 15,000.
