The Monument Protection Act regulates the preservation of monuments in the public interest. For this reason, the Monument Protection Act stipulates a reservation of approval for pending changes to monuments. This can also affect renovations or repairs to the interior of a monument as well as changes to the external appearance.

In the case of ground monuments, earthworks and construction work can have an altering effect on the ground monuments, meaning that such measures also require approval.

Therefore, if you wish to carry out alterations to monuments and these measures do not require planning permission, you will need a permit from the relevant lower monument protection authority.

If planning permission is required, the listed building permit will be issued as part of the planning permission. In this case, please submit an application for approval of changes to installations (building permit) to the responsible building supervisory authority. The building supervisory authority will contact the relevant monument protection authority or monument specialist authority on its own initiative.

• For ground monuments: preliminary investigation/prospecting

• You are the owner of a monument and would like to make changes to your monument that do not require planning permission.
• As an authorized representative or proxy, you need an effective power of representation or power of attorney from the monument owner.
• The monument protection authority will generally check whether there are any reasons relating to monument protection or monument preservation that could speak against this alteration measure.

If you would like to make changes to your monument that do not require planning permission (for example, replacing the front door or windows), you as the monument owner or authorized representative must apply to the relevant lower monument protection authority for a monument permit for these measures.

• Complete the application and submit it in writing or electronically (in the alternative written form) together with the required documents.
• The responsible lower monument protection authority will check the requirements in consultation with the monument protection authority.
• In individual cases, you must submit further documents for a comprehensive examination.
• The competent lower monument protection authority will inform you of the result of the application review in the form of a written decision.
