A building charge can be deleted from the register of building charges if there is no longer any public interest in the obligation. Deletion can be carried out ex officio by the lower building supervisory authority or at the request of a landowner.

A building charge is a declaration of obligation under public law in which the owner or owners undertake to do, tolerate or refrain from doing something on their property. The property is "encumbered" by the building obligation.

The legal basis for building encumbrances isSection 82 of the Thuringian Building Code (ThürBauO). The building encumbrance becomes legally effective when it is entered in the register of building encumbrances at the lower building supervisory authority.

A building charge can be deleted from the register of building charges if there is no longer any public interest in the obligation. Deletion can be carried out ex officio by the lower building supervisory authority or at the request of a landowner. The building obligation is relinquished by means of a written waiver from the building supervisory authority. Prior to the waiver, the obligated party and the beneficiaries of the building obligation are heard. The waiver becomes effective when the building obligation is deleted from the register of building obligations.

Fees are charged for the deletion of a building charge from the register of building charges at the request of the property owner.
