- § Section 17 of the Air Traffic Act (LuftVG)
- Number 14 Section V of Annex 1 to the Aviation Administration Cost Ordinance (LuftkostV)
- Number 21.2 General Administrative Regulation on the marking of aeronautical obstacles
Would you like to erect an aviation obstacle? Then, under certain conditions, you must apply in advance for a permit from the relevant aviation authority.
If you want to erect installations, trees or equipment, for example a crane, the safety of air traffic may be at risk. Deepening the ground may also count as a hazard under certain circumstances. Therefore, under certain conditions, you will need a permit from the relevant aviation authority. Depending on the federal state, you can submit the application in writing or online.
However, if you already have planning permission for your project, additional approval from the aviation authority is not necessary.
A hazard to air traffic arises primarily in the vicinity of airfields, airports or landing sites for helicopters. The height of your building project therefore also depends on its proximity to such a location. When approving an airfield, the aviation authority may stipulate that its consent is required for planning permission in the following cases:
- within a radius of 1.5 kilometers of an airfield for all construction projects
- for structures that are 25 meters higher than the airfield and within a radius of 4 kilometers of the airfield
This area is called the restricted construction protection area. Permission may also be required for very high obstacles or obstacles on elevated ground outside the restricted construction protection area. The relevant aviation authority can provide you with information on the approval requirement for your project.
Submit the application before starting the project. Specify the type of obstacle, the location and the height in meters above ground and in meters above sea level of the top of the obstacle. Also state the date of installation and, in the case of temporary obstacles, the duration until when the obstacle will be in place.
- Application with details of:
- Type of obstacle
- Location, geographical coordinates in degrees, minutes and according to the World Geodetic System 1984 (WGS 84)
- Height in meters above ground and in meters above sea level of the top of the obstacle and
- date of installation and
- in the case of temporary obstacles, the duration of their presence
- Sketch or view drawing of the obstacle
- Site plan or topographical map at a scale of 1:10,000 or 1:25,000 showing the location and extent of the obstacle, e.g. crane location and boom width
- Approval is granted on the following basis:
- Location and height of the obstacle
- if no danger to aviation is to be expected
- if necessary, subject to conditions, e.g. for marking
The aviation authority informs owners of affected properties about the new designation of construction protection areas at airfields.
- Erection of aviation obstacles Approval
- Anyone wishing to erect an aviation obstacle may require prior approval under aviation law
- Depending on their location and height, aviation obstacles are, for example
- trees
- construction equipment
- cranes
- masts
- Installations, for example wind turbines
- Overhead power lines
- Ground excavations
- Application not necessary if a building application already exists
- Required information:
- Type of aviation obstacle
- Description of the location of the structure or facility
- Coordinate and height information
- Date of erection and, if applicable, duration of service life
- Person responsible for installation
- Different height limits depending on the distance to an airfield, heliport or airport
- Registration online or in writing depending on the federal state
- Deadline: depending on the federal state
- Responsible: Aviation authority of the respective federal state
The application in Rhineland-Palatinate is submitted to the Rhineland-Palatinate State Mobility Office.
