If you do not know the course of your parcel boundary or you can no longer find your boundary markers (e.g. boundary stones) in the locality, you can apply for official boundary information under certain conditions.
Official boundary information" is information from the real estate register that is provided on site. Existing boundary markers that were not visible, for example, are uncovered and displayed or boundary points are marked temporarily, e.g. with wooden stakes. Official boundary markers are not reset: no administrative procedure takes place and your border neighbors are not involved.
Official boundary information can only be provided for you where the boundary points concerned have already been determined with high precision and reliability in the past. The surveying office checks whether this requirement is met. If this is not the case, the course of the boundary can only be determined and formally established by means of an official administrative procedure - the boundary determination.
Show in a sketch or detailed description for which boundary points the official boundary information is to be carried out. You can obtain a map basis for creating the sketch at: Katasterkarten-online.
In the event that you are not the owner of the land or the owner of the land or entitled to hereditary building rights, you will need an informal power of attorney from the parcel owner or the person entitled to hereditary building rights. .
You can submit an application for official boundary information if you are
- the owner of the property,
- a person entitled to hereditary building rights or
- are authorized by one of the aforementioned persons.
Furthermore, official boundary information can only be issued if either boundary markers have already been recorded in the real estate register and are of a certain quality or if the boundary points were created by surveying after 1986 and have been formally established by a surveying office. This technical examination is carried out by the surveying office.
The official boundary information is subject to a charge. The costs are based on the cost regulations for official surveying(KOVerm). The cost regulations are binding for the responsible surveying offices.
The costs are essentially based on the time required for the local work. In addition, there is a basic fee and a fixed fee for the provision of the official documents totaling € 215.
An official boundary survey, which takes 2 hours, including travel time, costs around €740.
You can obtain the official boundary information
- in writing or
- via the digital application procedure.
The application must contain the specific boundary points concerned
The surveying office checks whether the cadastral requirements for the issue of official boundary information are met.
The procedure for official boundary information is as follows:
Preparation, provision of the official documents,
- Arrangement of an appointment with the client,
- Carrying out the surveying work on site,
- uncovering the existing boundary markers,
- temporary marking of the boundary points where no boundary markers exist (e.g. using wooden stakes),
- Display of the boundary points on site for the client,
Preparation of the performance certificate.
The official boundary information can be provided within a few days, depending on how busy the surveying office is.
As the official boundary information does not interfere with the rights of the parties involved, no legal remedies are possible here.
An appeal can be lodged with the competent administrative court.
