From a legal point of view, the LFN is a special fund according to § 26 of the State Budget Code (LHO).
Citizens and companies can acquire land and real estate that the country no longer needs to fulfil its tasks.
In addition, the items received by the country through inheritances, such as crockery, jewellery or motor vehicles, are auctioned off to the highest bidder. This also applies to the land and real estate transferred to the Land from estates.
These inheritances ("fiscal inheritances") arise when there are no other heirs or the existing heirs renounce the inheritance.
The real estate assets (land and properties) owned by the state of Lower Saxony are managed by the Lower Saxony Real Estate Fund (LFN), which is part of the Lower Saxony Ministry of Finance. The LFN has the task of covering the state's real estate requirements and maintaining the state's real estate assets. The LFN also performs all of the state's tasks in connection with fiscal inheritances.
