Municipalities in which the adequate supply of housing for the population is particularly at risk can stipulate by statute that housing may only be used for non-residential purposes with permission. In some cases, no approval is required by law.

In principle, however, permission must be granted if overriding public interests or other interests worthy of protection in the preservation of the residential space prevail.

In the event of deliberate or negligent action, this can be punished with an administrative offense of up to 100,000 euros in fines.
