If you want to open a private hospital, private maternity hospital or private psychiatric clinic, you must apply for a license.
If you, as an entrepreneur, want to operate a private hospital, private maternity facility, or private psychiatric clinic, you need a license. A license is an official permit to conduct a specific business. To obtain a license, you must meet certain personal, structural, and operational-organizational requirements.
- Certificate of good conduct for submission to an authority (document type O) of the persons designated to manage the facility
- Extract from the Central Trade Register for submission to an authority
- Certificate from the insolvency court
- Information from the electronic enforcement portal (debtor register/asset register)
- Certificate in tax matters from the tax office (formerly: certificate of clearance)
- Commercial register entry
- If applicable: Articles of association
- Evidence to ensure qualified personnel (e.g. employment contracts, qualifications, licensure and specialist certificates), in particular
- Filling the position of medical director
- Specialists (if there are several specialties, evidence must be provided for each specialty)
- Representation of the medical director by a doctor of the same qualification
- Evidence of cooperation (e.g., anesthesia, laboratory, therapeutic measures, medical-technical services, obstetrics department, laundry, catering)
- Copy of the text of the building permit
- Cadastral site plan with compass direction
- Construction drawings (floor plans, sections with details of the dimensions of the rooms, windows and doors as well as the purpose of the rooms and the number of beds in each room)
- Description of construction and operation (location of the property, building structure, furnishings of patient and treatment rooms, description of the operating procedures, indications, and type and extent of treatment measures for each indication, equipment and organizational measures for managing complications or emergencies, as well as information on patient catering, call and alarm systems, emergency power supply, air conditioning systems (bed) elevators, hygiene reports and plans)

- Staffing plan (target state) reflecting the intended staffing in the medical and nursing areas, including the respective educational qualifications

- Regulation of on-call duty
- Proof of appointment of a hygiene officer and presentation of proof of further training
- Calculation of the need to employ a hygiene specialist
- Information on other hygiene officers (hygiene officers in nursing, medical assistants with corresponding functions)
- Submission of the contract for consultation by a hospital hygienist
If necessary, the responsible authority will request further documents from you.
- You have the necessary reliability to manage or administer an institution or clinic.
- You can ensure the medical and nursing care of your patients.
- The descriptions and plans you have submitted for structural and other technical facilities comply with health and safety requirements.
- Your operation does not cause any significant disadvantages or dangers for any persons living or staying in your business premises or for the neighbouring areas.
- There are no structural or technical deficiencies regarding health requirements.
- You submit your application along with the necessary documents to the responsible authority.
- The responsible authority checks whether the requirements are met.
- If necessary, the competent authority will involve other specialist authorities, such as the health authority, the building inspectorate and the food inspection authority.
- If necessary, the responsible authority will obtain opinions from the neighborhood, fellow residents, local police, municipal authorities and other external bodies.
- The responsible authority will inform you of the decision on your application in writing.
The license is granted for an indefinite period, provided no changes are made to the clinic premises or similar. The license expires if you do not commence operations within one year of its granting or if you have not continued operating the clinic for a period of one year.
